Memorandum of Understanding between the Civil Aviation Authority of Singapore and Transport Canada Civil Aviation Concerning Civil Aviation Safety

The Civil Aviation Authority of Singapore (“CAAS”) of the Republic of Singapore and Transport Canada Civil Aviation (“TCCA”) of Canada (hereinafter referred to as “The Participants”)

1. (a) Considering the importance and significant contribution of civil aviation to the economic development of their respective countries; and

2. (b) Desiring to deepen their current bilateral cooperation and exchange their experience and technical knowledge in the field of civil aviation safety;

Have Reached The Following Understanding:

1 Purpose

The Participants will promote and expand their cooperation in the field of civil aviation safety, through various mechanisms, to the mutual benefit of their respective countries.

2 Areas of Cooperation

1. (a) The Participants may cooperate in the following areas

   1. (i) Technical Arrangements and Sharing of Safety Information;

   2. (ii) Regulations and policy;

   3. (iii) Training and skills development; and

   4. (iv) Other areas they may jointly decide upon in writing.

2. (b) The Participants understand that possible activities related to these areas of cooperation are listed in Appendix A.

3. Implementation and coordination

1. (a) The Participants will facilitate cooperation between civil aviation authorities in their respective countries through face to face meetings, site visits, videoconferences, and other means of communication in order to coordinate and consult on matters identified under this Memorandum of Understanding (MOU).

2. (b) The Participants may constitute a Joint Working Group comprising of their representatives to oversee the application of this MOU and to define and review the progress of activities carried out under this MOU.

3. (c) Where appropriate and possible, the Participants will facilitate the participation of other institutions, organizations, academic and private sectors, as well as other levels of government, including supporting the interaction between the private and public sectors (including state-owned companies) of Canada and Singapore in order to stimulate mutual investment and other forms of economic cooperation under this MOU.

4. (d) The Participants will jointly decide in writing their specific roles in any activity carried out under this MOU, including any financial arrangement and participation of any third party in a Specific Instrument. The Participants understand that, if there is any inconsistency between the terms of this MOU and the Specific Instrument, the terms of the Specific Instrument will prevail.

5. (e) The Participants understand that their cooperation under this MOU will be subject to their respective national laws and regulations.

6. (f) The Participants understand that communications regarding the activities carried out under this MOU will be in writing and delivered via email or regular mail to the addresses in Appendix B.

4. Financial and resource matters

Each Participant will pay for its own costs incurred in the implementation of this MOU. The Participants understand that all activities carried out under this MOU are subject to the availability of their respective resources and to further arrangements between appropriate institutions. This MOU is not intended to entail a commitment or obligation of specific resources by either side.

5. Exchange of information

1. (a) The Participants understand that any sensitive information exchanged during the activites carried out under this MOU will remain the exclusive property of the disclosing Participant.

2. (b) The Participants will only use such information in relation to the activites conducted under this Memorandum.

3. (c) The Participants will not make available any sensitive information derived from the activities carried out under this MOU to a third party without prior written permission from the providing Participant.

4. (d) The Participants will ensure that third parties, invited to participate in any of the activities carried out under this MOU, protect sensitive information from further disclosure as a condition of their participation.

5. (e) The Participants will ensure that any information exchanged under this MOU is not disclosed after its termination, without the prior written consent of the providing Participant.

6. Differences in Interpretation and Implementation

The Participants will resolve any differences in the interpretation and implementation of this MOU through consultations.

7. Status

This MOU is not legally binding.

8. Reporting

The Participants will report on the activities carried out under this MOU on a regular basis.

9. Final Provisions

1. (a) The Participants may amend this MOU at any time upon their mutual written consent.

2. (b) A Participant may terminate this MOU at any time, by giving a written ninety (90) days’ notice to the other Participant.

3. (c) The Participants, may by mutual consent, provide for the survival of any arrangement described in a Specific Instrument despite the discontinuation of this MOU.

4. (d) This MOU will take effect on the date of the signature of its English version by the Participants.

Signed in duplicate in Singapore, on 9 April 2019 in the English language. The Participants will sign the French version within 60 days, each version being equally valid.

Appendix A

Proposed Areas For Cooperation

Technical Arrangements and Sharing of Safety Information

This may include exploring the possibility of entering into arrangements on airworthiness certifications (covering certification approvals, remotely piloted aircraft systems (RPAS), maintenance, and personnel licensing). This may also include the sharing of information and best practices related to aviation safety measures through seminars, workshops, visits and other ideas as appropriate.

Regulations and Policy

This may include joint research projects and study on topics in aviation safety of mutual interest to the Participants, for the purpose of capability development, flight operations enhancement, and/or to have a better in-depth understanding of new approaches adopted by the International Civil Aviation Organisation (ICAO) and the industry in enhancing or promoting aviation safety, consquently resulting in continued collaboration at ICAO on key international issues. This may also include the exchanges of views, best practices and experiences, as well as expertise and know-how, on the formulation and implementation of aviation safety policies, regulations and procedures. Such exchanges may include, but are not limited to, cybersecurity, safety oversight, State Safety Programme, Safety Management Systems and exchange of safety information such as operational and technical hazards and incidents, safety performance indicators and data, trend analysis and mitigating measures.

Training and skills development

This may include exploring partnerships in aviation skills training, including the involvement of private sector institutions as appropriate. This may also include personnel exchange programmes and study visits in areas of mutual interest to the Participants. The Participants may also consider jointly conducting or hosting training and skills development events on aviation safety for the benefit of their officials or extend participation in such events to officials of other aviation regulatory authorities and representatives of their respective industries.

Other areas

This may be jointly decided upon in writing by the Participants.
