EXEMPTION FROM CLAUSE 705.124(2)(b)(iv)(C) AND SECTIONS 7.8.5(1) AND 7.6.8(1) OF THE FLIGHT ATTENDANT TRAINING STANDARD (TP 12296) made pursuant to PARAGRAPH 705.124(1)(b) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to adversely affect aviation safety, I hereby exempt Jazz Aviation LP, Suite 318, 5955 Airport Road, Mississauga, Ontario L4V 1R9, from the requirements of clause 705.124(2)(b)(iv)(C) of the Canadian Aviation Regulations (CARs) and sections 7.8.5(1) (Initial) and 7.6.8(1) (Annual) of the Flight Attendant Training Standard (TP12296) made pursuant to paragraph 705.124(1)(b) of the CARs, subject to the conditions set out below.

Paragraph 705.124(1)(b) stipulates that every air operator shall establish and maintain a training program in respect of flight attendants, approved in accordance with the Commercial Air Service Standard (CASS) and the Flight Attendant Training Standard.

Clause 705.124(2)(b)(iv)(C) stipulates that an air operator’s training program shall include, in respect of flight attendants, initial and annual training, including emergency procedures training.

Sections 7.8.5(1) (Initial) of the Flight Attendant Training Standard states; “Each trainee shall demonstrate the effectiveness of a fire extinguisher correctly applied to an actual fire while wearing a P.B.E”. 

Section  7.6.8(1) (Annual) of the Flight Attendant Training Standard states; “Once every third annual training year, each crew member shall demonstrate the effectiveness of a fire extinguisher correctly applied to an actual fire while wearing a P.B.E”.

PURPOSE

This exemption enables Jazz Aviation LP to conduct its live fire fighting training without the requirement for each trainee to wear protective breathing equipment (P.B.E.).

APPLICATION

This exemption is applicable only to Jazz Aviation LP’s Live Fire Fighting Training Programs as required by Standard TP12296.

CONDITIONS

This exemption is subject to the following conditions:

  1. Jazz Aviation LP shall ensure that each trainee wears a P.B.E. during the Class B Cargo Fire Fighting Drills required by Initial, Section 7.8.8 and Cabin Fire Fighting Drill required by Initial, Section 7.8.6 of the Flight Attendant Training Standard
  2. Jazz Aviation LP shall ensure that each trainee wears a P.B.E. at least once every three years, during the Cabin Fire Fighting Drill required by Annual, Sections 7.6.4 and 7.6.7 of the Flight Attendant Training Standard (TP12296);
  3. Jazz Aviation LP shall amend its flight attendant training programs to include the subject matter set out in conditions 1 and 2.

VALIDITY

This exemption is in effect until the earliest of the following:

  1. On August 12, 2017 at 23:59 (EDT);     
  2. the date on which any of the conditions set out in this exemption is breached; or
  3. the date on which this exemption is cancelled in writing by the Minister where she is of the opinion that it is no longer in the public interest or that it is likely to adversely affect aviation safety.
