EXEMPTION FROM SUBSECTION 302.07(1)(a)(ii) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt the Montreal International Airport, Dorval from the requirement set out in subsection 302.07(1)(a)(ii) of the Canadian Aviation Regulations (CARs) which stipulates that the operator of an airport shall comply in respect of any part or facility of the airport that has been replaced or improved, in accordance with the standards set out in the aerodrome standards and recommended practices publication, as it read on the date on which the part or facility was returned to service, subject to the following conditions.

Purpose

The purpose of this exemption is to exempt Montreal International Airport, Dorval from the requirement to provided a precision approach category I lighting system to serve a precision approach Category I on runway 06R, as stipulated in the standards set out in the aerodrome standards and recommended practices publications.

Application

This exemption applies to the operator of Montreal International Airport, Dorval.

Conditions

This exemption is subject to the following conditions:

  1. The Decision Height (DH) of runway 06R be not lower than 250 feet above the threshold height;
  2. The advisory visibility for the approach be not less than 3/4 of a statute mile.

Validity

This exemption is in effect until the earliest of the following:

  1. the date on which the appropriate Cat I approach lighting system is installed ;
  2. 05:00 UTC on 1 November 1999;
  3. the date on which the condition specified in the exemption is not complied with; or
  4. the date on which the exemption is cancelled by the Minister, in writing, where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.
