EXEMPTION FROM SUBSECTION 602.11(2) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt persons operating aircraft with engines mounted on the rear fuselage, from the requirements set out in subsection 602.11(2) of the Canadian Aviation Regulations (CARs), in accordance with the purpose and application of this exemption and subject to the following conditions.

Subsection 602.11(2) states that no person shall conduct or attempt to conduct a take-off in an aircraft that has frost, ice or snow adhering to any of its critical surfaces.

PURPOSE

The purpose of this exemption is to permit persons utilizing aircraft with engines mounted on the rear fuselage, to conduct take-off with Hoar-frost on the fuselage after it has been determined that no other contaminant is adhered to the fuselage.

APPLICATION

This exemption shall only apply to all persons in Canada during operations under ground icing conditions when utilizing aircraft with engines mounted on the rear fuselage, to conduct take-off with Hoar-frost on the fuselage after it has been determined that no other contaminant is adhered to the fuselage.

CONDITIONS

This exemption is subject to the following conditions:

1. hoar-frost shall be the only acceptable contaminant on the fuselage of aircraft with engines mounted on the rear fuselage;

2. hoar-frost shall not be mixed with other contaminants such as ice or snow prior to conducting a takeoff. If any other contaminant or contaminants are found on the fuselage, the entire fuselage shall be de-iced;

3. a copy of this exemption shall be attached to the Aircraft De-icing/Anti-icing Procedures in the Operator’s Manual.

VALIDITY

This exemption is in effect until the earliest of:

  1. December 31, 2005, 23:59 EST;
  2. the date on which an amendment to the appropriate provisions of the CARs and related standards come into effect;
  3. the date on which any of the conditions set out in the exemption is breached; or
  4. the date on which the exemption is cancelled in writing by the Minister where he is of the opinion it is no longer in the public interest or is likely to effect aviation safety.
