Enforcement officers eligible for designation under the Canada Shipping Act, 2001

The persons or classes of persons across Canada listed below are eligible to be designated as enforcement officers under the Canada Shipping Act, 2001 (Part 5 - Vessel Operation Restriction Regulations, and Part 10 - Pleasure craft) for the purposes of promoting compliance and enforcement of the Vessel Operation Restriction Regulations and regulations applicable to pleasure craft.

  • A member of the Royal Canadian Mounted Police
  • A member of any harbour or marine police force or patrol
  • A member of any provincial, territorial, county, municipal or First Nation and Inuit community police force
  • A federal park warden, marine conservation area warden or game officer
  • A person employed as conservation officer by the National Capital Commission
  • A federal fishery officer or fishery guardian
  • A provincial or territorial conservation officer, wildlife officer or park ranger
  • A provincial or territorial forest officer
  • A provincial or territorial or municipal peace officer
  • A provincial or territorial or municipal special constable or inspector
  • A member of any county or municipal fire service (firefighter)
  • An enforcement officer appointed under the Canada Marine Act
  • A member of a private safety or security organization contracted by a local authority
  • A marine safety inspector
  • A pleasure craft safety inspector

Local authorities interested in establishing or expanding enforcement capacity within their jurisdiction are required to contact their respective regional Office of Boating Safety for further information on eligibility and training requirements for enforcement personnel.

Sources of police and powers of enforcement officers

  • Enforcement officers responsible for the enforcement of Part 5 of the Canada Shipping Act, 2001 (CSA 2001) will be designated under subsection 135(1.1) of that Act.
  • Enforcement officers responsible for the enforcement of Part 10 of the Canada Shipping Act, 2001 (CSA 2001) will be designated under subsection 196(1) of that Act.
  • Enforcement powers of officers designated under the CSA 2001 are derived from subsection 135(2) of that Act.
