EXEMPTION FROM PARAGRAPH 571.08(1)(b) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to adversely affect aviation safety, I hereby exempt persons who perform maintenance on General Electric (GE) turbofan engine models CF34-SC, CF34-8E and CF34-10E installed or intended to be installed on Canadian aircraft (“maintenance persons” hereinafter) from compliance with the requirements set out in paragraph 571.08(1)(b) of the Canadian Aviation Regulations (CARs), subject to the conditions below.

This exemption applies:

  1. Only with respect to the installation of GE CF34-8C, CF34-8E and CF34-10E engine fan blades that have undergone maintenance performed and certified by IHI Corporation (IHI), of 229 Tonogaya, Mizuho-Machi, Nishitama-Gun, Tokyo 190-1297, Japan; and
  2. Only until such time as an agreement or technical arrangement between Canada and Japan is in place that provides for the reciprocal recognition of each party’s maintenance certifications, subject to the conditions specified herein.

Section 571.08 of the CARs states:

(1) No person shall install a used part on an aeronautical product, other than aircraft that are operated under a special certificate of airworthiness in the owner-maintenance or amateur-built classification, unless the part meets the standards of airworthiness that are applicable to the installation of used parts and are set out in Chapter 571 of the Airworthiness Manual and

(a) is an airworthy part that has been removed from an aircraft for immediate installation on another aircraft;

(b) is an airworthy part that has undergone maintenance for which a maintenance release has been signed pursuant to paragraph 571.11(2)(c); or

(c) has been inspected and tested to ensure that the part conforms to its type design and is in a safe condition, and a maintenance release has been signed to that effect.

(2) If, under the terms of a loan agreement or an air operator parts pooling agreement, a used part has been obtained from a source not subject to these Regulations, no person shall permit the part to remain in service for longer than 90 days unless specifically authorized by the Minister on receipt of documentation demonstrating that the part conforms to the applicable type design.

PURPOSE

The purpose of this exemption is to authorize persons who perform maintenance on GE turbofan engine models CF34-8C, CP34-8E and CF34-10E, installed or intended to be installed on Canadian aircraft, to install specified part number fan blades that have undergone maintenance and which are accompanied by a maintenance release contained in an Authorized Release Certificate issued by IHI, despite the fact IHI does not hold an approved maintenance organization (AMO) certificate issued by the Minister pursuant to section 573.02 of the CARs, and only until such time that an agreement or technical arrangement between Canada and Japan that provides for the reciprocal recognition of each party’s maintenance certifications is in place.
