AUTHORIZATION PURSUANT TO PARAGRAPH 702.22(2)(a) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to paragraph 702.22(2)(a) of the Canadian Aviation Regulations and after taking into account that the authorization is in the public interest and is not likely to affect aviation safety, I hereby authorize Helijet International Inc., 5911 Airport Road South, Richmond, BC, to operate an aircraft over a built-up area at distances less than those specified in paragraph 602.14(2)(a), subject to the following conditions.

Paragraph 702.22(2)(a) states that for the purpose of subsection 602.15(2)(a) a person may operate an aircraft over a built-up area at altitudes and distances less than those specified in paragraph 602.14(2)(a), if the person has an authorization from the Minister or is authorized to do so in an air operator certificate.

PURPOSE

The purpose of this authorization is to allow Helijet International Inc., 5911 Airport Road South, Richmond, BC, to conduct aerial operations at altitudes of less than 1000 feet above and less than 500 feet horizontal distance from the highest obstacle over the City of Vancouver, BC, for the purpose of aerial photography.

APPLICATION

This authorization applies to Helijet International Inc., 5911 Airport Road South, Richmond, BC, when operating for the purpose of aerial photography for the television series "Smallville" over the City of Vancouver BC.

CONDITIONS

This authorization is subject to the following conditions:

  1. The operation will take place on Thursday, December 5, 2002; alternatively on Friday, December 6, 2002 between the hours of 1830 and 2200 local time, depending on suitable weather conditions.
  2. Operations will be conducted within the specified hours, under Night VFR conditions, using an AS355 type helicopter.
  3. The sites, and routes flown of the operation shall be as depicted on the map submitted and held on file with Commercial and Business Aviation, Pacific Region; being:
    1. the site immediately West and North of the Marine building at 355 Burrard Street, Vancouver, BC; and
    2. the route between Seymour street, West bound along Pender Street to Burrard Street, then North Bound via Burrard Street to Burrard Inlet, Vancouver, BC.
  4. Local police authorities and municipalities concerned shall be informed of and acknowledge the operation.
  5. The aircraft shall at all times be flown along a flight path which, in case of an engine failure or other in-flight emergency necessitating an immediate landing, shall ensure a suitable (autorotational) landing site without endangering persons or property on the ground.
  6. aircraft shall conduct a power check immediately before commencing the operation, and the engines shall be at, or above, the manufacturers specifications.
  7. The aircraft shall be flown in compliance within the "Height-Velocity Diagram contained with the approved Aircraft Flight Manual.
  8. The aircraft indicated airspeed (IAS) be more than the safe single-engine speed (Vsse) when no suitable landing area is available.
  9. The aircraft shall be configured such that safe single engine fly away is assured at all times.
  10. When engaged in operations at the site as under (c) i) above, the altitude shall not be less than 250 feet above ground level (AGL) at any time.
  11. When engaged in operations at the site as under (c) i) above, the vertically projected flight path of the aircraft shall remain clear of the public view area immediately West of the Marine building at all times.
  12. When engaged in operations at the site as under (c) i) above, that section of West Hastings Street leading from Burrard Street West bound to the public over pass shall be closed to, and clear of, all pedestrian and vehicular traffic.
  13. When engaged in operations at the site as under (c) i) above, the Marine building at 355 Burrard Street and the Federal Building at 401 Burrard Street shall be vacant of all persons.
  14. When engaged in operations on the route as under (c) ii) above, the height of the aircraft shall not be less than 300 feet AGL, or not below the rooftop of the highest building on that route, which ever is the highest.
  15. The transit route to and from the site and routes as under (c) above, shall be flown in accordance with Canadian Aviation Regulation 602.14, Minimum Altitude and Distances.
  16. All personnel involved are briefed on the operation, safety precautions and emergency procedures before flight operations commence.
  17. Persons carried on board the helicopter shall be limited to essential crew only.
  18. Radio communications shall be established between the helicopter and Ground Safety Coordinator.
  19. Prior to any night operations the pilot has inspected the site, approach and departure paths under daylight conditions.
  20. A copy of this authority shall be carried on board the aircraft while operating in Canada.
  21. The operation shall be coordinated with the appropriate Air Traffic Control authority.

VALIDITY
The authorization is in effect until the earliest of the following:

  1. 2200 hours local time, British Columbia, on Friday, December 6, 2002;
  2. the date on which any of the conditions set out in this authorization is breached; or
  3. the date on which this authorization is cancelled, in writing, by the Minister, where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.
