EXEMPTION FROM CLAUSE 705.124(2)(b)(iv)(B) OF THE CANADIAN AVIATION REGULATIONS AND FROM PARAGRAPHS 7.3.1(a) OF THE INITIAL AND 7.1.1(a) OF THE ANNUAL PART SEVEN OF THE FLIGHT ATTENDANT TRAINING STANDARD, MADE PURSUANT TO PARAGRAPH 705.124(1)(b) OF THE...

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to adversely affect aviation safety, I hereby exempt Jazz Aviation LP (known as Jazz), Airway Centre, Suite 318, 5955 Airport Road Mississauga, Ontario L4V 1R9 from the requirements of clause 705.124(2)(b)(iv)(B) of the Canadian Aviation Regulations (CARs) and from the requirements of paragraph 7.3.1(a) of the Initial and 7.1.1(a) of the Annual Part Seven of the Flight Attendant Training Standard (FATS) (TP12296E) made pursuant to paragraph 705.124(1)(b) of the CARs, subject to the conditions set out below.

Paragraph 705.124(1)(b) of the CARs states that every air operator shall establish and maintain a training program that is approved by the Minister in accordance with the Commercial Air Service Standards (CASS) and, in respect of flight attendants, in accordance with the CASS and the FATS.

Clause 705.124(2)(b)(iv)(B) of the CARs stipulates that an air operator’s training program shall include, in respect of flight attendants, initial and annual training, including aircraft type training.

Paragraph 7.3.1(a) of the Initial and 7.1.1(a) of the Annual Part Seven of the FATS states that each drill shall be performed using the appropriate aircraft or approved training device.

PURPOSE

This exemption allows Jazz to conduct initial and annual training for Aircraft Exit Operation Drills as required by paragraphs 7.3.1(a) of Initial Part Seven and 7.1.1(a) of Annual Part Seven of the FATS without operating the Q400 2L/2R exit.  Currently, the Schedule A of the FATS– Aircraft Exit Compatibility Groups – does not recognize an alternative to the Q400 2L/2R exits.

This exemption allows Jazz to treat as equivalent the operation of the CRJ 100/200/705 1R exit and the Q400 2L/2R exit.

APPLICATION

This exemption is applicable to Jazz Aviation LP only when conducting the Jazz’s approved initial and annual training Flight Attendant program pertaining to the aircraft Q400 2L/2R exit operation.

CONDITIONS

This exemption is subject to the following conditions:

  1. Jazz’s approved Initial & Annual Flight Attendant Training Program shall include and emphasize the differences between the Q400 2L/2R exit and the CRJ 100/200/705 1R exit as set out in Appendix 1;
  2. Jazz shall use this exemption only and for the sole purpose of conducting Jazz Aviation LP’s flight attendant approved initial training & annual programs pertaining to the Q4002L/2R drill;
  3. Jazz shall clearly identity in each flight attendant’s record that the CRJ 100/200/705 1R was used as an equivalent means to operating the Q400 2L/2R exit for aircraft operation drills; and
  4. Jazz shall ensure that each flight attendant attending the approved initial & annual training program meets all of the other applicable requirements as set in the CARs, the CASS and in the FATS.

VALIDITY

This exemption is in effect until the earliest of:

  1. April 15, 2017 at 23:59 EST;
  2. the date on which any of the conditions set out in this exemption is breached; or
  3. the date on which this exemption is cancelled in writing by the Minister where he or she is of the opinion that it is no longer in the public interest or that it is likely to adversely affect aviation safety.
