EXEMPTION FROM SUBSECTION 703.98(1) OF THE CANADIAN AVIATION REGULATIONS AND SUBSECTION 723.98(27) OF THE COMMERCIAL AIR SERVICE STANDARDS – AIR TAXI - AEROPLANES

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to adversely affect aviation safety, I hereby exempt Canadian air operators identified in the “Application” section of this document, from the minimum training time requirements – for aeroplanes that are certificated for 20 or more passenger seats – listed in Minimum Initial Flight Training Time (Table I) and Minimum Recurrent Flight Training Time (Annual) (Table II) under subsection 723.98(27) of the Commercial Air Service Standards (CASS)made pursuant to subsection 703.98(1) of the Canadian Aviation Regulations (CARs).  This exemption is subject to the conditions mentioned in this document.

PURPOSE

The purpose of this exemption is to standardize the application of minimum training time requirements for Canadian air operators conducting operations under Subpart 703 of the CARs utilizing aeroplane types identified in the “Application” section of this document. This exemption aims to permit these air operators, while operating the aeroplane types identified in the “Application” section of this document, to use those minimum training times specified for Multi-engine aircraft certificated for 10 to 19 passenger seats , as listed in Minimum Initial Flight Training Time (Table I) and Minimum Recurrent Flight Training Time (Annual) (Table II) under subsection 723.98(27) of the CASS.

APPLICATION

This exemption applies to Canadian air operators conducting operations under Subpart 703 of the CARs, utilizing propeller-driven aeroplane types that initially had models certificated for 19 or less passenger seats (excluding normal flight crewmember seats), and later included models (of the same type) that were certificated for 20 or more passenger seats. Examples of such aeroplane types include, but are not necessarily limited to the DHC 6 “Twin Otter” Series. For the purpose of this exemption, these aircraft shall be operated in a configuration to carry no more than 9 passengers.

CONDITIONS

  1. For the purpose of initial and recurrent pilot training, the air operator should utilize the minimum training times specified for Multi-engine aircraft certificated for 10 to 19 passenger seats, as listed Minimum Initial Flight Training Time (Table I) and Minimum Recurrent Flight Training Time (Annual) (Table II), under subsection 723.98(27) of the CASS, made pursuant to subsection 703.98(1) of the CARs;

  2. The exemption is only applicable to propeller-driven aeroplane types, having a Maximum Certified Takeoff Weight (MCTOW) of 19,000 lb (8 618 kg) or less, that were originally certificated for 19 or less passenger seats, and later included models (of the same type) that were certificated for 20 or more passenger seats;

  3. This exemption is only applicable to aircraft which meet the requirements of Condition 2 (above), that are operated in a configuration to carry no more than 9 passengers; and

  4. The air operator shall submit revisions to their initial and recurrent pilot training programs resulting from this exemption to Transport Canada Civil Aviation, and obtain the Minister’s approval of such changes, in accordance with subsection 703.98(1) of the CARs.

VALIDITY

This exemption is in effect until the earliest of the following:

  1. January 31, 2015 at 23:59 EST;

  2. The date on which an amendment to the appropriate provisions of the CARs and related standards comes into effect;

  3. The date on which the condition set out in this exemption is breached; or

  4. The date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest or that it is likely to adversely affect aviation safety.

CANADIAN AVIATION REGULATIONS

Training Program

703.98 (1) Every air operator shall establish and maintain a ground and flight training program that is

  1. designed to ensure that each person who receives training acquires the competence to perform the person's assigned duties; and

  2. approved by the Minister in accordance with the Commercial Air Service Standards .

  1. In Tables I and II,

    1. the term "flight training time" means "flight time";

    2. the terms "Level A", "Level B" and "Level C" refer to the approved training program, not to the certification level of the simulator used.

  2. Pilots flying in a two crew environment must receive PNF flight training in the simulator or aircraft in addition to the PF times required in tables I and II.
