EXEMPTION FROM CLAUSE 705.124(2)(b)(iv)(B) OF THE CANADIAN AVIATION REGULATIONS, AND PARAGRAPHS 7.3.1(a) OF THE INITIAL AND 7.1.1(a) OF THE ANNUAL PART SEVEN OF THE FLIGHT ATTENDANT TRAINING STANDARD MADE PURSUANT TO PARAGRAPH 705.124(1)(b) OF THE CA...

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Air Canada, Air Canada Centre – 1210, P.O. Box 14000, Postal Station Saint Laurent, Montreal, Quebec, H4Y 1H4 from the requirements of clause 705.124(2)(b)(iv)(B) of the Canadian Aviation Regulations (CARs) and from the requirements of paragraph 7.3.1(a) (Initial) and 7.1.1(a) (Annual) of the Flight Attendant Training Standard (TP12296) made pursuant to paragraph 705.124(1)(b) of the CARs, subject to the conditions set out below.

Paragraph 705.124(1)(b) of the CARs stipulates that every air operator shall establish and maintain a training program that is approved by the minister in accordance with the Commercial Air Service Standard (CASS) and the Flight Attendant Training Standard.

Clause 705.124(2)(b)(iv)(B) of the CARs stipulates that an air operator’s training program shall include, for flight attendants: initial and annual training, including aircraft type training.

Paragraph 7.3.1(a) of the Flight Attendant Training Standard (Initial) states: Each drill shall be performed using the appropriate aircraft or approved training device”.

Paragraph 7.1.1(a) of the Flight Attendant Training Standard (Annual) states: Each drill shall be performed using the appropriate aircraft or a training device approved in accordance with Section 705.126 of the Canadian Aviation Regulations”.

PURPOSE

The purpose of this exemption is to allow Air Canada to use a B767 over wing exit as an equivalent means of operating an EMB 190/195 over wing exit during Initial and Annual Flight Attendant Training as required by section 7.3.1(a) Initial Part Seven and section 7.1.1(a) Annual Part Seven of the Flight Attendant Training Standard.

APPLICATION

This exemption is applicable only to Air Canada’s flight attendant training programs, pertaining to the aircraft over wing exit operation drill.

CONDITIONS

This exemption is subject to the following conditions:

  1. Air Canada shall amend its flight attendant Initial and Annual Flight Attendant Training Program to include and emphasize the differences between the B767 over wing exit and EMB 190/195 over wing exit;
  2. Air Canada shall use this exemption only and for the sole purpose of conducting Air Canada’s flight attendant initial training and annual programs pertaining to the over wing exit operation drill;
  3. Air Canada shall clearly identity in each flight attendant’s record that a B767 over wing exit was used as an equivalent means to operating an EMB 190/195 over wing exit for aircraft operation drills;
  4. Air Canada shall ensure that each flight attendant attending the initial and annual training meets all of the other applicable requirements as set in the CARs, the Commercial Air Service Standard and the Flight Attendant Training Standard.

VALIDITY

This exemption is in effect until the earliest of the following:

  1. July 15, 2013 at 23:59 EST;
  2. the date on which any of the conditions set out in this exemption is breached; or
  3. the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it no longer in the public interest, or that it is likely to affect aviation safety.
