EXEMPTION FROM SECTION 602.33 OF THE CANADIAN AVIATION REGULATIONS

Pursuant to Subsection 5.9(2) of the Aeronautics Act, and after having taken into account that the exemption is both in the public interest and is not likely to affect aviation safety, I hereby exempt British Airways, P.0 Box 10, Lester B. Pearson International Airport, Toronto AMF, Ontario, L5P 1A2, from the requirement set out in Section 602.33 of the Canadian Aviation Regulations (CARs), that no person shall operate an aircraft at a true Mach number of 1 or greater, subject to the attached Schedule of Conditions.

PURPOSE AND APPLICATION

The purpose of this exemption is to enable British Airways to operate their Concorde aeroplanes in supersonic flight at a true Mach number of 1 or greater in Canadian airspace.

VALIDITY

This exemption is in effect from August 16, 2000 to October 12, 2000, or until the earliest of the following:

  1. the date on which any condition set out in the exemption is breached; or
  2. the date on which the exemption is cancelled, in writing, by the Minister where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.

Schedule of Conditions

The entry/exit routes into and out of Canada must be as follows:

  1. PRAWN (Oceanic) 57 12.2 N 59 10.8 W DCT LOMTA 57 12.2 N 62 37.2 W DCT TEALS 55 38.9 N 67 00.0 W DCT TRIPE 53 15.7 N 72 29.7 W DCT 50 55.1 N 75 04.2 W. For westbound flights the aircraft must be at less than MACH 1.0 by 50 55.1 N 75 04.2 W and for eastbound flights the acceleration point is 50 55.1 N 75 04.2 W. Due to possible conflicts with westbound traffic, British Airways is advised that there may be a requirement to issue an eastbound climb restriction at FL410 or above the TRIPE.
  2. British Airways must operate the Concorde aircraft only in accordance with the schedule set out in Annex 1 (attached).
  3. British Airways undertakes to indemnify Her Majesty against any claims which may arise as a result of these flights.
