NCR-019-2017

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to adversely affect aviation safety, I hereby exempt Canadian air operators operating under Subpart 5 of Part VII of the Canadian Aviation Regulations (CARs) from the requirements of Section 6 of the “Introduction” –  Aviation First Aid and Part 8 of the “Initial” – Aviation First Aid stipulated in the Flight Attendant Training Standard made pursuant to subsection 705.124(1) and clause 705.124(2)(b)(iv)(E) of the CARs and from Section 6 of Part A – First Aid of the Flight Attendant Manual Standard made pursuant to subsections 705.139(2) and (3) of the CARs, subject to the following condition.

Relevant provisions of the CARs and relevant parts of the Flight Attendant Training Standard (TP 12296) and the Flight Attendant Manual Standard (TP 12295) are reproduced in part in Appendix A.

Purpose

The purpose of this exemption is to allow a Canadian air operator operating under Subpart 5 of Part VII of the CARs to exclude first aid training from its flight attendant training program and a first aid section from its flight attendant manual.

As an employer, a Canadian air operator operating under Subpart 5 of Part VII of the CARs is required to comply with the Aviation Occupational Health and Safety Regulations, including Part 9 – First Aid.

Application

This exemption applies to a Canadian air operator operating under Subpart 5 of Part VII of the CARs.

This exemption ceases to apply to the Canadian air operator who breaches the condition of the exemption.

Condition

This exemption is subject to the following condition:

  1. No air operator shall permit a person to act — and no person shall act — as a flight attendant unless the person has received the training set out in section 9.5 of the Aviation Occupational Health and Safety Regulations and the validity period of the training has not expired.

Validity

This exemption is in effect from December 1, 2017 at 00:01 EST until the earliest of:

  1. November 30, 2022 at 23:59 EST; or
  2. The date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest or is likely to adversely affect aviation safety.

  1. 1. Every air operator shall establish and maintain a training program that is
    1. designed to ensure that each person who receives training acquires the competence to perform the person’s assigned duties; and

705.139 Flight Attendant Manual
  1. 1. Every air operator, other than an air operator that is authorized solely for the transport of cargo in its air operator certificate, shall establish and maintain, as part of its company operations manual, a flight attendant manual for the use and guidance of flight attendants in the operation of its aircraft.
  2. 2. A flight attendant manual shall contain the instructions and information necessary to enable flight attendants to perform their duties safely and shall contain the information required by the Flight Attendant Manual Standard.
  3. 3. The Minister shall, where the Flight Attendant Manual Standard is met, approve those parts of a flight attendant manual, and any amendments to those parts, that relate to the safety and emergency information contained in Part A of the Flight Attendant Manual Standard.

  • Referenced in the Flight Attendant Manual,

    1. Regulatory Approval Process

      To obtain regulatory approval of an Aviation First Aid Training Program, or a revision to an approved program, an air operator shall submit the program to the Minister together with written evidence from an “accepted agency” or Health Canada that the program or revision meets the first aid training standard and that the content is technically accurate. Ministerial approval will then be granted and the program or revision can be implemented.

    2. Accepted Agencies

      An accepted agency is a first aid organization/agency that has received acceptance from Health Canada for their Aviation First Aid Training Program.

    3. Instructor Qualification

      Instructors shall be qualified in accordance with CAR 705.124 and the program of the “accepted agency.”

    4. Equipment and Procedures Criteria

      Training program content and delivery shall be consistent with the amount and type of equipment carried on the air operator’s aircraft and the air operator procedures that have been published.

    5. Validity Period

      First Aid Training is valid for three years from the month in which the course was completed.
