EXEMPTION FROM SUBPARAGRAPH 702.07(2)(b)(ii) OF THE CANADIAN AVIATION REGULATIONS AND CLAUSE 722.07(2)(b)(i)(C) OF THE COMMERCIAL AIR SERVICES STANDARDS (HELICOPTER)

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after having taken into account that the exemption is both in the public interest and is not likely to affect aviation safety, I hereby exempt 102662 Canada Inc., 40 Boteler Street, Suite 802, Ottawa, Ontario, KIN 9C8 from the requirements of clause 722.07(2)(b)(i)(C) of the Commercial Air Service Standards (CASS) made pursuant to subparagraph 702.07 (2)(b)(ii) of the Canadian Aviation Regulations, subject to the condition set out below.

Subparagraph 702.07(2)(b)(ii) requires an air operator to appoint a Chief Pilot in accordance with the CASS.

Clause 722.07 (2)(b)(i)(C) of the CASS stipulates that Chief Pilots must have as qualifications at least 500 hours of flight time, of which 250 hours were acquired within the preceding three years on the same category of aircraft being operated by the air operator.

PURPOSE

The purpose of this exemption is to allow 102662 Canada Inc. to appoint a Chief Pilot who has not acquired 250 hours within the preceding three years on the category of aircraft operated by the air operator, as required by clause 722.07(2)(b)(i)(C) of the CASS.

APPLICATION

This exemption applies to 102662 Canada Inc., 40 Boteler Street, Suite 802, Ottawa, Ontario, KIN 9C8 Air Operator Certificate number 8654.

CONDITIONS

This exemption is subject to the following condition:

  1. 102662 Canada Inc. employs and appoints Kenneth Pothier, licence No. AH 201421 as Chief Pilot.

VALIDITY

This exemption is in effect until the earliest of the following:

  1. the date on which the foregoing condition is not complied with;
  2. the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest or that it is likely to affect aviation safety or for cause; or
  3. March 1,2006 at 23:59 EST.
