AUTHORIZATION PURSUANT TO PARAGRAPH 702.22(2)(a) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to paragraph 702.22(2)(a) of the Canadian Aviation Regulations and after taking into account that the authorization is in the public interest and is not likely to affect aviation safety, I hereby authorize Omega Air Corporation, 4360 Agar Drive, Richmond, B.C., to operate a helicopter over a built-up area at altitudes and distances less than those specified in paragraph 602.14(2)(a).

Paragraph 702.22(2)(a) states that for the purpose of subsection 602.15(2)(a) a person may operate an aircraft over a built-up area at altitudes and distances less than those specified in paragraph 602.14(2)(a), if the person has an authorization from the Minister or is authorized to do so in an air operator certificate.

Purpose

The purpose of this authorization is to permit Omega Air Corporation, 4360 Agar Drive, Richmond, B.C., to operate a helicopter at altitudes of less than 1000 feet above and less than 500 feet horizontal distance from the highest obstacle within the built-up area of the City of Vancouver, and the Municipality of Delta, B.C.

Application

This authorization applies only to Omega Air Corporation, 4360 Agar Drive, Richmond, B.C., when operating for the purpose of aerial photography operations for a British Telecom Commercial in the City of Vancouver, and Annacis Island, Municipality of Delta, B.C.,

Conditions

This authorization is subject to the following conditions:

  1. The operation shall take place on Sunday, June 6, 2004, alternatively on Monday, June 7, 2004 between the hours of 05:45 and 19:00, Pacific Standard Time (PST) depending on suitable weather conditions.
  2. Operations at Location 1 as under (e) below, shall take place between 10:00 and 15:00 hours PST.
  3. Operations at location 2 as under (e) below, shall take place before 07:00 hours PST.
  4. Operations shall be conducted within the specified hours, under day VFR conditions, using an AS355 type helicopter.
  5. The routes of the operation shall be as depicted on the map submitted and held on file with Commercial and Business Aviation, Pacific Region; being:
    1. Location 1 – The Vancouver B.C., Down Town city core (West End);
    2. Location 2 – Stanley Park, Vancouver, B.C.; and
    3. Location 3–Annacis Island Waste Water Treatment Plant, Annacis Island, Municipality of Delta.
  6. The aircraft shall at all times be flown along a flight path which, in case of an engine failure or other in-flight emergency necessitating an immediate landing, shall ensure a suitable (autorotational) landing site without endangering persons or property on the ground, or on the water.
  7. The aircraft shall be flown in compliance within the "Height-Velocity" Diagram contained with the approved Aircraft Flight Manual.
  8. The aircraft shall conduct a power check immediately before commencing the operation, and the engines shall be at, or above, the manufacturers specifications.
  9. The height of the aircraft when engaged in flight operations at Location 1 as under (e) above, shall never be less than 400 feet above ground level (AGL), or not below 50 feet above the height of the rooftop of the Hyatt Hotel, Burrard Street, Vancouver, whichever is the higher.
  10. When engaged in flight operations at Location 1 as under (e) above, the minimum horizontal distance from the waterfront buildings shall never be less than 100 feet.
  11. When engaged in flight operations at Location – 2 as under (e) above, the aircraft shall remain well clear of the Vancouver Stanley Park aquarium and assemblies of persons at all times.
  12. When engaged in flight operations at Location – 2 as under (e) above, when traversing the shoreline north of but well clear of Third Beach, that section of the shoreline extending to 150 feet laterally to either side of the projected flight patch, shall be, and will remain clear of all persons.
  13. When engaged in flight operations at Location – 2 as under (e) above, when traversing the shoreline north of Third Beach, pedestrian traffic control shall be in force.
  14. When engaged in flight operations at Location 3 as under (e) above, the aircraft shall remain clear of Highway 91 and the Alex Fraser Bridge, by not less than 300 feet at all times.
  15. When engaged in flight operations at Location 3 as under (e) above, the aircraft shall remain clear of all public buildings, assemblies of persons and water treatment basins.
  16. When engaged in flight operations at Location 3 as under (e) above, and when circling the Waste Water Treatment Plant, the height of the aircraft shall never be less than 100 feet above ground level (AGL).
  17. The transit route to and from the routes as under (e) above, shall be flown in accordance with Canadian Aviation Regulation 602.14, Minimum Altitude and Distances.
  18. All personnel involved shall be briefed on the operation, safety precautions and emergency procedures before flight operations commence.
  19. Persons carried on board the helicopter shall be limited to essential crew only.
  20. The aircraft shall not fly over any residential buildings, or assemblies of persons at any time.
  21. A copy of this authority shall be carried on board the aircraft while operating in Canada.
  22. The operation shall be coordinated with the appropriate Air Traffic Control authority.
  23. A co-ordinated plan for each complete operation shall be developed.
  24. The aircraft shall comply with the Commercial Air Service Standards as required under CAR 702.22(2)(b).

Validity

The authorization is in effect until the earliest of the following:

  1. 19:00 hours PST
on Monday, June 7, 2004;
  • the date on which any of the conditions set out in this authorization is breached; or
  • the date on which this authorization is cancelled, in writing, by the Minister, where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.
