AUTHORIZATION PURSUANT TO PARAGRAPHS 702.22(1)(a) and 702.22(2)(a) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to paragraphs 702.22(1)(a) and 702.22(2)(a) of the Canadian Aviation Regulationss and after taking into account that the authorization is in the public interest and is not likely to affect aviation safety, I hereby authorize Omega Air Corporation, 4360 Agar Drive, Richmond, B.C., to conduct landings and take-offs in an aircraft within a built-up area of a city or town at a place other than an airport or a military aerodrome, and to operate an aircraft over a built-up area at altitudes and distances less than those specified in paragraph 602.14(2)(a), subject to the following conditions.

Paragraph 702.22(1)(a) states that for the purpose of subsection 602.13(1), a person may conduct a take-off, approach or landing in an aircraft within a built-up area of a city or town at a place other than an airport or a military aerodrome, if the person has an authorization from the Minister or is authorized to do so in an air operator certificate.

Paragraph 702.22(2)(a) states that for the purpose of subsection 602.15(2)(a) a person may operate an aircraft over a built-up area at altitudes and distances less than those specified in paragraph 602.14(2)(a), if the person has an authorization from the Minister or is authorized to do so in an air operator certificate.

Purpose

The purpose of this authorization is to allow Omega Air Corporation, 4360 Agar Drive, Richmond, B.C., to conduct landings and take-offs and to operate a helicopter at altitudes of less than 1000 feet above and less than 500 feet horizontal distance from the highest obstacle within the built-up area of the City of Vancouver, B.C.

Application

This authorization applies only to Omega Air Corporation, 4360 Agar Drive, Richmond, B.C., when operating for the purpose of filming the motion picture "Catwoman" at Stanley Park, over the Downtown core and adjacent waterfront, Vancouver, B.C.

Conditions

This authorization is subject to the following conditions:

  1. The operation shall take place on Thursday, February 5, 2004, Friday, February 6, 2004 and/or Monday, February 9, 2004 between the hours of 12:00 and 19:00 Pacific Standard Time (PST), depending on suitable weather conditions.
  2. Operations shall be conducted within the specified hours, under VFR conditions, using an AS355 type helicopter. The Pilot shall be Jim Filippone, License No. CH259531.
  3. The site of the operation shall be as depicted on the map submitted and held on file with Commercial and Business Aviation, Pacific Region; being:
     
    Site 1: The aircraft will conduct landings and takeoffs at a temporary landing site on the South East field at Brockton Oval. The aircraft will then over fly Brockton Oval, and the Totem Poles at 100 feet Above Ground Level (AGL) and descend over Stanley Park Drive to 25 Feet AGL in Stanley Park, Vancouver, B.C.
    Site 2: Approach from the South at 400 feet AGL while over the Downtown core and descend when over the adjacent waterfront to 50 feet AGL. Approach from the North ascending from 25 ASL feet to 400 feet AGL while over the Downtown core, Vancouver, B.C.
     
  4. The landing and take-off profiles shall be arranged such that in the event of an engine failure, the aircraft can safely land without creating a hazard to persons or property on the ground.
  5. The approach to and departure from, Site 1 shall be via the shortest route to the foreshore.
  6. The landing zone shall be clearly marked, secured and access denied to all pedestrians and vehicular traffic.
  7. Stanley Park Drive, the Seawall, Brockton Oval and the Totem Pole areas shall be closed to and clear of all pedestrian and vehicular traffic within a 100 Metre Radius of the aircraft while the rotors are turning
  8. The aircraft shall maintain a 50 Metre separation from all surface vessels.
  9. The aircraft shall be flown in compliance within the "Height-Velocity" Diagram contained with the approved Aircraft Flight Manual.
  10. The aircraft shall conduct a power check immediately before commencing the operation, and the engines shall be at, or above, the manufacturers specifications.
  11. The aircraft shall be configured such that safe single engine fly away is assured at all times.
  12. The aircraft shall maintain a minimum of 100 feet AGL while over flying the totem pole area Site 1 as under (c) above.
  13. Operations at Site 1 as under (c) above shall be limited to Day VFR only.
  14. The aircraft shall maintain a minimum of 400 feet AGL while over flying the downtown core, Site 2 as under (c) above.
  15. All personnel involved shall be briefed on the operation, safety precautions and emergency procedures before flight operations commence.
  16. Persons carried on board the helicopter shall be limited to essential crew only.
  17. Radio communications shall be established between the helicopter and Ground Safety Coordinator.
  18. The local police authorities and municipalities concerned shall be informed of and acknowledge the operation.
  19. The transit route to and from the sites as under (c) above, shall be flown in accordance with Canadian Aviation Regulation 602.14, Minimum Altitude and Distances.
  20. A copy of this authority shall be carried on board the aircraft while operating in Canada.
  21. The operation shall be coordinated with the appropriate Air Traffic Control authority.
  22. The aircraft shall comply with the Commercial Air Service Standards as required under CAR 702.22(1)(b) and CAR 702.22(2)(b).

Validity

The authorization is in effect until the earliest of the following:

  1. 19:00 hours PST, British Columbia, on Monday, February 9, 2004;
  2. the date on which any of the conditions set out in this authorization is breached; or
  3. the date on which this authorization is cancelled, in writing, by the Minister, where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.
