EXEMPTION FROM PARAGRAPHS 7.8.5(a) AND 7.6.7(a) OF THE FLIGHT ATTENDANT TRAINING STANDARD AND CLAUSE 705.124(2)(b)(iv)(C) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Skyservice Airlines Inc. (hereinafter "Skyservice") , 31 Fasken Drive, Etobicoke, Ontario M9W 1K6 from the requirements of Paragraphs 7.8.5(a) (Initial training) and 7.6.7(a) (Annual training) of the Flight Attendant Training Standard (TP 12296) made pursuant to clause 705.124(2)(b)(iv)(C) of the Canadian Aviation Regulations ("CARs").

The requirements of Paragraphs 7.8.5(a) and 7.6.7(a) of the Flight Attendant Training Standard (TP 12296) are detailed in Appendix A to this exemption.

The requirements of Clause 705.124(2)(b)(iv)(C) of the CARs are detailed in Appendix B to this exemption.

PURPOSE

The purpose of this exemption is to permit Skyservice to conduct Initial and Annual live fire fighting training without the requirement for each trainee to wear protective breathing equipment ("P.B.E.").

APPLICATION

This exemption is applicable only to Skyservice’s live fire fighting training programs as required in the Flight Attendant Training Standard.

CONDITIONS

This exemption is subject to the following conditions:

  1. Skyservice shall ensure each trainee wears a P.B.E. during the cabin fire training drill required by Initial, Section 7.8.6 of the Flight Attendant Training Standard.
  2. Skyservice shall ensure each trainee wears a P.B.E., at least once every three years, during the cabin fire fighting drill required by Annual, Section 7.6.4 of the Flight Attendant Training Standard.
  3. Skyservice shall amend its flight attendant training programs to include conditions 1 and 2 and shall remove the use of the PBE during live fire fighting.
  4. Skyservice shall submit its amended flight attendant training programs for approval by the Minister pursuant to paragraph 705.124(1)(b) of the CARs.

VALIDITY

This exemption is in effect until the earliest of:

  1. EST 23:59 on June 30, 2004;
  2. the date on which the exemption is superseded by an amendment to the Canadian Aviation Regulations or its associated standards;
  3. the date on which any of the conditions set out in this exemption is breached; or
  4. the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.
