EXEMPTION FROM SUBSECTION 602.62(4) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is both in the public interest and is not likely to affect aviation safety, I hereby exempt Canadian operators operating with one or more flight attendants under subpart 604 of the Canadian Aviation Regulations (CARs) or operating with one or more flight attendants under subpart 705 of the CARs from the requirement of subsection 602.62(4) of the CARs, subject to the following conditions.

Subsection 602.62(4) stipulates that, where life preservers are required to be carried on board the aircraft in accordance with subsections 602.62(1), (2) or (3) of the CARs, the life preservers for infants be stowed in a location that is easily accessible to the person for whose use it is provided, when that person is seated.

PURPOSE

The purpose of this exemption is to allow Canadian operators operating with one or more flight attendants under subpart 604 or 705 of the CARs to stow infant life preservers in a bulk stowage location that is easily accessible to the flight attendant(s). The flight attendant(s) will provide an infant life preserver to each person responsible for an infant when preparing for a ditching.

APPLICATION

This exemption applies only to:

  1. 604 Canadian operators operating with one or more flight attendants when conducting 604 operations; and
  2. 705 Canadian air operators operating with one or more flight attendants when conducting 604 or 705 operations.

CONDITIONS

This exemption is subject to the following conditions:

  1. At least one flight attendant shall be assigned to the flight.
  2. The infant life preservers shall be stowed in an approved location that is easily accessible by the flight attendant(s).

  3. This stowage location shall be indicated by way of a clearly visible placard.
  4. The flight attendant, when preparing for a ditching, shall distribute infant life preservers to the persons responsible for an infant.
  5. The operator shall amend the applicable parts of the operations manual and crew member training programs to reflect the changes in emergency and safety procedures required by the introduction of the alternate infant life preserver stowage location authorized by this exemption.
  6. The operator shall have written receipt of the Minister’s approval of the amendments to the operations manual and crew member training programs set out in condition 5.

VALIDITY

This exemption will be valid commencing on May 1, 2004 and until one of the earliest:

  1. 23:59 EST, May 1, 2006;
  2. the date on which any condition set out in this exemption is breached;
  3. the date on which an amendment to the appropriate provision of the Canadian Aviation Regulations or related Commercial Air Service Standards comes into effect; or
  4. the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest or is likely to affect aviation safety.
