EXEMPTION FROM SUBSECTION 704.115(2)(a)(ii) OF THE CANADIAN AVIATION REGULATIONS AND SUBSECTION 724.115(23)(d) OF THE COMMERCIAL AIR SERVICE STANDARDS (AEROPLANE)

Pursuant to subsection 5.9(2) of the Aeronautics Act, and having taken into account that the exemption is both in the public interest and is not likely to affect aviation safety, I hereby exempt the air operator SAGGAS INTERNATIONAL AERONAUTICS SERVICES INC./SERVICES AÉRONAUTIQUES SAGGAS INTERNATIONAL INC. c/o/b SAGGAS International, 475 Dumont Street, Suite 201, Dorval, Quebec H9S 5W2 from the requirements of  subsection 724.115(23)(d) (aeroplane) of the Commercial Air Service Standards (CASS) and to subparagraph 704.115(2)(a)(ii) of the Canadian Air Regulations (CARs).

Subsection 704.115(2)(a)(ii) requires air operator’s ground and flight training programs to include line indoctrination training for flight crew members.

Subsection 724.115(23)(d) of the CASS stipulates that sufficient line indoctrination is to be provided to flight crew members to become familiar with air operator routes when a PPC is transported from one air operator to another.

Purpose

The purpose of this exemption is to permit SAGGAS International, operating services under Subpart 4 of Part VII of the Canadian Aviation regulations to employ a qualified Cessna Citation II (C550) flight crew member under the provisions of CASS 724.115(23), Transportability of Pilot Proficiency Check, without requiring the air operator to provide the required line indoctrination as stated in CASS 724.115(23)(d).

Application

This exemption applies to Captain Steve Chamberlain, licence AA382839, when conducting line indoctrination duties on Mr. Edwin Houston, licence number AA159211, Mr. Yvan Laforge, licence number AA121800, Mr. Roger Foster, licence number AA383903 and Mr. Ron MacDorman, licence number AA220113.

Conditions

  1. all other conditions of CASS 724.115(23) shall be met
  2. Captain Steve Chamberlain shall only be utilized for duties indicated in the application of this exemption.

Validity

This exemption is in effect until the earliest of the following:

  1. September 15th, 2004 at 23:59 EDT;
  2. The date on which one of the conditions set out in the exemption is breached;
  3. The date on which this exemption is cancelled, in writing by the Minister, where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.
