Pursuant to subsection 5:9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Air Canada, P.O. Box 9000 Station Airport, Dorval, Québec, H4Y 1C2 from the requirement set out in section 507.02 of the Canadian Aviation Regulations (CARs) requiring that an aircraft, to be eligible for Canadian registration and certification, shall fully comply with all standards of airworthiness, subject to the following conditions.
PURPOSE
The purpose of this exemption is to allow Air Canada to operate one Airbus Aircraft A340 without the installation of heated cargo drainage system as stated in Transport Canada Type Certificate Data Sheet A-166.
APPLICATION
This exemption applies only to Airbus A340 Aircraft, Registration Number C-FDRO, Serial Number 048, when operated by Air Canada.
CONDITIONS
This exemption is subject to the following conditions:
- This exemption is conditional to the continuing ownership and direct operation of the subject aircraft by Air Canada.
- The aircraft shall be maintained on a Transport Canada approved inspection/maintenance schedule.
- The following measures shall be incorporated to the Air Canada Maintenance Program in order to prevent excessive ice formation/accumulation in the lower fuselage area under the fwd and aft cargo compartments;
During the period of November 1, 2005 to April 30, 2006 and November 1 to December 15, 2006- EVERY SERVICE CHECK (48 Hrs Clock Time)
- Ensure snow and ice are swept out of the fwd and aft cargo compartments.
- Ensure the drains located in each cargo compartment are clean.
- WEEKLY (As recommended in AMM Task 12-31-51-660-801 Cold Weather Maintenance)

- Remove one floor panel from the fwd end of the aft cargo compartment and check for ice in the lower fuselage per AMM subtask 12-31-51-660-051.
- Remove one floor panel in the fwd cargo compartment and check for ice in the lower fuselage per AMM subtask 12-31-51-660-051.
If ice in found in preceding steps, put the aircraft in a warm hangar (or leave it outside if temperature is above freezing point) with cargo doors open until ice melts down completely and all water flows out through the fuselage drain valves. - Reinstall floor panels as per AMM task 53-00-00-400-803.
- EVERY SERVICE CHECK (48 Hrs Clock Time)
- The subject aircraft shall comply with the requirements of any embodied Department of Transport (DOT) approved or accepted design change. Any design change to be embodied on the subject aircraft shall be established by a competent person, to be compatible with any of the limits authorized by this exemption and not to adversely affect the airworthiness of the modified aircraft.
- A copy of this exemption shall be kept in the subject Aircraft's Technical File.
- Appropriate entries to identify this exemption shall be made in the subject aircraft's Journey Log Book and Technical File.
- This exemption does not constitute and shall not be used as basis for an airworthiness approval of the current modifications embodied on the subject aircraft.
- During the validity period of this exemption, should additional airworthiness concerns or data compromising the safety of the subject aircraft be brought to the attention of Transport Canada, the latter may at any time cancel or modify this exemption.
VALIDITY
This exemption is in effect until the earliest of the following:
- This exemption is valid for 18 months from June 15, 2005 to December 15, 2006 at 23:59 EST;
- the date on which any condition set out in this exemption is breached; or
- the date on which this exemption is canceled in writing by the Minister of Transport where he is of the opinion that it is no longer in the public interest or is likely to affect aviation safety.
