EXEMPTION FROM SECTION 571.04 OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt persons performing ultrasonic inspection on Bell 204B, 205A, 205A-1, 205B and 212 helicopter Main Rotor Grips, mandated by Federal Aviation Administration (FAA) Airworthiness Directive AD 2003-01-04, from section 571.04 of the Canadian Aviation Regulations (CARs). The requirements of section 571.04 are attached as Appendix A of this exemption. This exemption is subject to the conditions set out below.

Purpose

The purpose of this exemption is to allow appropriately qualified persons, other than employees of AMOs with an applicable rating in the NDT category or persons authorized in accordance with 571 Appendix K, to perform ultrasonic inspections on Bell 204B, 205A, 205A-1, 205B and 212 helicopter Main Rotor Grips in accordance with Bell Helicopter Textron Inc. (BHTI) Non Destructive Inspection Procedure, Log No. 00-340, Revision E as identified in FAA AD 2003-01-04.

Application

The exemption applies to the holder of an appropriately rated Aircraft Maintenance Engineer (AME) licence who has successfully completed the Bell Helicopter Textron Inc. (BHTI) training program outlined in the latest Alert Service Bulletin (ASB) 212-02-116 or 205B-02-39, as applicable. This exemption will allow this qualified AME to perform the ultrasonic inspection on Bell 204B, 205A, 205A-1, 205B and 212 helicopter Main Rotor Grips in accordance with Bell Helicopter Textron Inc. (BHTI) Non Destructive Inspection Procedure, Log No. 00-340, Revision E as identified in FAA AD 2003-01-04.

Conditions

This exemption is subject to the following conditions:

  1. The person who performs the work shall sign the maintenance release for the work;
  2. The person who performs the work shall be the holder of an appropriately rated AME licence, who has successfully completed the Bell Helicopter Textron Inc. (BHTI) training program outlined in the latest Alert Service Bulletin (ASB) 212-02-116 or 205B-02-39, as applicable. The appropriate training program shall be a minimum of 16 hours in duration;
  3. The inspection shall be performed in compliance with the procedures described in the Bell Helicopter Textron Inc. (BHTI) Non Destructive Inspection Procedure, Log No. 00-340, Revision E as identified in FAA AD 2003-01-04;
  4. The maintenance release for the inspection shall include a reference to this exemption; and
  5. All other applicable requirements of the Canadian Aviation Regulations shall be met.

Validity

This exemption comes into effect on August 1, 2005 at 00:00 EST, and is in effect until the earliest of the following:

  1. January 31, 2007 at 23:59 EST;
  2. The date on which any condition set out in this exemption is breached;
  3. The date on which an amendment is brought to the appropriate provisions of the CARs; or
  4. The date on which this exemption is cancelled in writing by the Minister where he or she is of the opinion it is no longer in the public interest, or is likely to affect aviation safety.

APPENDIX A - Specialized Maintenance

CAR 571.04 No person shall perform the specialized maintenance set out in Schedule II to this Subpart on an aeronautical product other than an aircraft operated under a special certificate of airworthiness in the owner-maintenance or amateur-built classification, except in accordance with

  1. a maintenance policy manual (MPM) established by the holder of an approved maintenance organization (AMO) certificate issued pursuant to Section 573.02 with a rating of a category appropriate to the work to be performed; or
  2. a foreign document equivalent to an MPM established by a maintenance organization approved under the laws of a state that is party to an agreement with Canada, and the agreement provides for recognition of the work to be performed.

The following tasks constitute the specialized maintenance referred to in section 571.04 of these Regulations.

8.

Any required inspection of an aeronautical product that uses liquid penetrant, magnetic particle, radiographic, ultrasonic or eddy current methods, unless the inspection is performed under Appendix K to Standard 571 - Maintenance, is Non-Destructive Testing (NDT) Specialized Maintenance.
