AUTHORIZATION PURSUANT TO PARAGRAPH 704.01(c) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to paragraph 704.01(c) of the Canadian Aviation Regulations (CARs) and after taking into account that the authorization is in the public interest and is not likely to affect aviation safety, I hereby authorize Cougar Helicopters Inc 549 Barnes Drive, Suite 200, Enfield, Nova Scotia, Canada to operate Sikorsky S-92 helicopters under Subpart 704 of the CARs, notwithstanding that the S-92 exceeds the 8618 kgs (19000 pounds) maximum certified take-off weight (MCTOW) imposed by paragraph 704.01(a).

Paragraph 704.01(c) states that Subpart 704 applies in respect of the operation by a Canadian air operator, in an air transport service or in aerial work involving sightseeing operations, of any aircraft that is authorized by the Minister to be operated under Subpart 704.

Purpose

This authorization will allow Cougar Helicopters Inc to operate Sikorsky S-92 helicopters under Subpart 704, notwithstanding that the maximum certified take-off weight (MCTOW) of the aircraft exceeds the 8 618 kg (19,000 pounds) limit imposed by paragraph 704.01(a) of the CARs.

Application

This authorization applies to Cougar Helicopters Inc only for the purposes of operating Sikorsky S-92 helicopters under Subpart 704.

Conditions

This authorization is subject to the following condition:

Cougar Helicopters Inc.

shall transport no more than 19 passengers in the S-92 helicopter.

Validity

The authorization is in effect until the earliest of the following:

  1. July 15, 2007 at 23:59 EDT;
  2. the date on which an amendment to the appropriate provisions of the CARs comes into effect;
  3. the date on which this authorization is cancelled, in writing, by the Minister, where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.

Authorization Cancellation

The authorization issued under paragraph 704.01(c) of the Canadian Aviation Regulations (CARs), to Cougar Helicopters Inc. on the 8th day of September, 2004, at Ottawa, by the Director Commercial & Business Aviation, on behalf of the Minister of Transport, is hereby cancelled because it is the opinion of the Minister that it is no longer in the public interest or is likely to affect aviation safety.
