EXEMPTION FROM SECTION 507.02(b) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Western Express Air Lines Inc., Unit B — 5455 Airport Road South, Richmond, BC, V7B 1B5 from the requirements of section 507.02(b) of the Canadian Aviation Regulations (CAR), subject to the conditions listed below.

Section 507.02 stipulates, "Where an application for a flight authority is made pursuant to Section 507.06, the Minister shall issue a certificate of airworthiness in respect of an aircraft (a) for which an aircraft type design has been certified pursuant to Subpart 11 and the certification is not restricted or provisional; (b) that conforms to its certified type design; and (c) that is safe for flight".

PURPOSE

The purpose of this exemption is to permit Western Express Air Lines Inc. to operate Bombardier Lear 31A aircraft serial number 68, which does not satisfy 507.02(b). Specifically, some of the aircraft modifications unique to Canadian registered Lear 31A aircraft cannot be installed at this time because parts are not available.

APPLICATION

This exemption applies to Western Express Air Lines Inc., Unit B — 5455 Airport Road South, Richmond, BC, V7B 1B5 specifically when operating Bombardier Lear 31A aircraft serial number 68.

CONDITIONS

This exemption is subject to the following conditions:

  1. The aircraft shall be operated in accordance with FAA approved Flight Manual FM-121 dated July 25 1991, at change 4, or later approved revision and Transport Canada approved Airplane Flight Manual Supplement AFMS W1239; and
  2. The aircraft shall be operated in an air ambulance interior configuration only.

VALIDITY

This exemption is in effect until the earliest of the following:

  1. 23:59 Pacific Standard Time on July 2, 2004;
  2. the date on which Learjet Inc. ECR 3186 and Belly Skid installations are accomplished;
  3. the date on which any of the conditions set out in this exemption is breached;
  4. the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest or that it is likely to affect aviation safety.

EXEMPTION CANCELLATION

The exemption from paragraph 507.02(b) of the Canadian Aviation Regulations issued to Western Express Air Lines Inc., Unit B — 5455 Airport Road South, Richmond, BC, V7B 1B5, on March 9, 2004, by David J. Nowzek, the Regional Director Civil Aviation, Pacific Region, on behalf of the Minister of Transport, is hereby canceled and is replaced with this exemption because it is the opinion of the Minister that it is no longer in the public interest or is likely to affect aviation safety.
