Whereas the Mascouche Airport in the City of Mascouche, in the Province of Quebec, is scheduled to close in November 2016;
Whereas the Corporation de l’aéroport de Mascouche has informed the Minister of Transport of its intent to develop a new aerodrome that will be located in both the City of Mascouche and the City of Terrebonne, in the Province of Quebec;
And whereas the Minister of Transport is of the opinion that the development of the new aerodrome is not in the public interest;
Therefore, the Minister of Transport, pursuant to section 4.31 of the Aeronautics Act, makes the annexed Order Prohibiting the Development of an Aerodrome in the Cities of Mascouche and Terrebonne.

Order Prohibiting the Development of an Aerodrome in the Cities of Mascouche and Terrebonne
Prohibition
1 A person must not develop an aerodrome within the limits of the City of Mascouche or the City of Terrebonne, in the Province of Quebec, unless
- (a) the person has carried out the consultation process set out in the schedule;
- (b) the person has provided the Minister with information that the Minister requires in order to evaluate any unadressed objections that are set out in the summary report referred to in section 4 of the schedule; and
- (c) the Minister has notified the person that the development of the proposed aerodrome may proceed.
Coming into force
2 This Order comes into force on the day on which it is signed.
SCHEDULE
(Section 1)
Consultation Process
Interested parties
1 For the purposes of this consultation process, the interested parties are
- (a) the Minister;
- (b) the providers of air navigation services;
- (c) the authority responsible for any natural area or habitat that is protected under federal legislation and located within a radius of 4 000 m from the location of the proposed aerodrome;
- (d) the City of Mascouche and the City of Terrebonne;
- (e) the operator of a certified or registered aerodrome located within a radius of 30 nautical miles from the location of the proposed aerodrome; and
- (f) the owner of any land bordering the land on which the proposed aerodrome is to be developed.
Notice and sign
2 The person, at least 75 days before the expected start date of the development of the proposed aerodrome,
- (a) provides the interested parties with a notice of the proposed aerodrome development; and
- (b) places a sign, in plain view of the public, at the location where the proposed aerodrome is to be developed.
Content of notice and sign
3 The person prepares a notice and a sign that set out the following:
- (a) a drawing showing the location of the proposed aerodrome;
- (b) a description of the proposed aerodrome;
- (c) the expected start date and completion date of the development of the proposed aerodrome;
- (d) a statement that the interested parties may provide their comments or objections to the person with respect to the proposed aerodrome;
- (e) contact information, including the mailing address, phone number and email address, for the contact persons to whom the interested parties may provide their comments or objections; and
- (f) the period, which must be at least 45 days, during which the interested parties may provide their comments or objections.
Summary report
4 At the end of the period referred to in paragraph 3(f), the person prepares a summary report that includes the following:
- (a) a description of the proposed aerodrome and its development;
- (b) a list of the interested parties who were notified under paragraph 2(a); and
- (c) a summary of the comments and objections received, the actions that the person proposes to take to address those comments and objections, and any objections that were not addressed, if applicable.
Communication of summary report
5 The person, within 30 days after the end of the period referred to in paragraph 3(f), provides the summary report to the Minister and makes it available to the other interested parties.
