Amendments to the Acts
Removing mandatory prepublication from the Acts provides several benefits.
One, it repeals a statutory provision that has been made redundant by the Cabinet Directive on Regulatory Management.
Two, where emergency action is required, the Governor in Council will have the power to expedite the enactment of regulatory amendments that respond to those emergencies and exempt the proposed amendments from publication in Part I of the Canada Gazette which is used to provide a comment period for stakeholders. In such cases, the final regulation would still be published in Part II of the Canada Gazette and made public when the regulations are finalized/enacted.
Three, this amendment removes an obstacle to more effective regulatory alignment between Canada and the United States. When regulatory changes have been agreed to by Canada and the United States to enhance regulatory cooperation, the Governor in Council will have the option of expediting enactments that facilitate cross-border business transactions.
