Civil Aviation publishes its corporate and non-corporate offenders list to both serve as a deterrent and to increase public awareness and education concerning aviation safety.
Only the names of the corporate entities that were issued a sanction will be posted. This means that when penalties are laid only against an employee of a corporation, without parallel charges being laid against the corporation, the information on the corporation will not be published.
Notices of Suspension and Notices of Administrative Monetary Penalties (AMPs) are drafted by investigators of the Regional Enforcement Units (REU) and approved by the REU Manager, on behalf of the Minister of Transport.
Notices of Suspension of Canadian aviation documents are administered in accordance with Canadian Aviation Regulations section 103.06(1), which is enabled by section 6.9 of the Aeronautics Act. Notices of Administrative Monetary Penalties are administered in accordance with Canadian Aviation Regulations section 103.08, which is enabled by sections 7.7 to 8.2 of the Aeronautics Act.
Corporate offender enforcement action summaries describe the circumstances related to contraventions committed for which a corporation will be sanctioned. They will be published in accordance with the following criteria:
- when an alleged offender is served with a Notice of Administrative Monetary Penalty, or
- when an alleged offender is served with a Notice of Suspension of a Canadian aviation document
This information is published quarterly and will remain posted for a period of twenty-four months before being archived.
