1.0 Purpose

The purpose of this ACSI is to define the delegate approval and authorization processes for Regional and Headquarters (HQ) Aircraft Certification personnel tasked with reviewing applications for Ministerial Delegation. The granting of Ministerial Delegation enables individuals appointed under Airworthiness Manual (AWM) Chapter 505 to perform the authorized functions of a Design Approval Representative (DAR) or a Delegated Organization, including a Design Approval Organization (DAO) or an Airworthiness Engineering Organization (AEO). The individuals in a DAO or an AEO will hereafter be referred to as Designated Engineers (DEs). These processes are not applicable to authorization of a DAO or AEO as a Delegated Organization.

Note:

Except if explicitly stated otherwise, the use of the term functions of a DAO or AEO (that is, DEs), and DARs, as applicable.

3.0 Background

3.1 The Aeronautics Act, Part I, paragraph 4.3(1), titled "Delegation by Minister" states that "The Minister may authorize members of the Royal Canadian Mounted Police or any other person to exercise or perform, subject to such restrictions or limitations as the Minister may specify, any of the powers, duties or functions of the Minister under this Part except, subject to subsection (3), any power conferred on the Minister by the Governor in Council to make regulations or orders."

3.2 As allowed by the Aeronautics Act, Transport Canada may authorize individuals to perform the functions of DEs and DARs, which consists of a number of administrative activities completed in support of the approval process and the authorization process.

  1. The Delegate approval process confirms that applicants meet the criteria listed in AWM Chapter 505 Subchapters B for an AEO, C for a DAR, or E for a DAO. The approval process also confirms that the Engineering Procedures Manual (EPM) developed by a DAR applicant meets the criteria listed in AWM Chapter 505 Subchapter C, and that the EPM or Design Approval Procedures Manual (DAPM) for an AEO or DAO respectively, reflects the appropriate Scope of Authority of its DEs and continues to meet the criteria listed in AWM Chapter 505 Subchapters B for an AEO or E for a DAO.
  2. On successful completion of the approval process, the authorization process makes sure that the necessary documentation is completed to enable the Ministerial Delegation.

 

 

 

 

 

4.0 Delegate Approval Process

4.0.1 The following sections describe the Delegate approval process, presented as a flowchart in Appendix A, which shall be used for review of delegate qualifications and for approval of DAR EPMs or revisions to Delegated Organization EPMs or DAPMs made as part of a DE application. AWM Chapter 505 sections 505.109, 505.203 and 505.409 govern the approval of Delegates, while sections 505.107 and 505.207 govern the approval of an EPM, and section 505.407 governs the approval of a DAPM. This approval process is applicable to both new applicants and to requests for changes to the Scope of Authority.

4.0.2 Aircraft Certification personnel reviewing DE applications received from a Delegated Organization should consult paragraph 4.3.2 below to determine the level of participation that the Delegated Organization may have in the approval process.

4.1 Application Submittal and Management Responsibility

Determination of where applications for delegation or changes to Scope of Authority should be sent will be based on the following criteria:

  1. Applicants requesting delegation as a DAR shall apply to the Transport Canada office in the Region where they reside. Delegation requests for the specialty function of Flight Test shall be sent to the Delegations & Quality Division in HQ (AARDL), which will coordinate the application review by the Flight Test Division (AARDC);
  2. Applicants requesting delegation as a DE in a Delegated Organization shall apply to the Transport Canada office with existing oversight responsibility for the Delegated Organization. The applicant shall adhere to the nomination and approval process specified in the their approved EPM or DAPM;
  3. Delegates requesting a change in their level of delegation shall apply to the Transport Canada office with existing oversight responsibility for them;
  4. Corporations requesting delegation as a Delegated Organization for AWM Chapter 511 Type Certification activities shall apply to the Delegations and Quality Division in HQ (AARDL), which will coordinate the approval and authorization of DEs as outlined in this ACSI; and
  5. Corporations requesting delegation as a Delegated Organization for AWM Chapter 513 repair or modification activities shall apply to the Transport Canada office in the Region where the corporation operates. They will coordinate the approval and authorization of DEs as outlined in this ACSI.

Note:

On determination of where the application should be sent, responsibility for the Delegate application approval process must be assigned to an Office of Primary Interest (OPI). For those applications where approval responsibility is with HQ, the Delegation & Quality Division (AARDL) will be the OPI. For those applications where approval responsibility resides in a Region, the Regional Manager, Aircraft Certification (RMAC) shall assign an OPI.

4.2 Application Pre-screening

The following pre-screening activities shall be completed on receipt of the application by the OPI:

  1. Enter the application into a project tracking system, obtain a project file number for reference in correspondence between the applicant and the OPI, and open a project file for the application package;
  2. Provide the applicant with confirmation of application receipt and status;
  3. Determine if the personnel qualification requirements of AWM Chapter 505 sections 505.109, 505.203, or 505.409, as appropriate to the requested delegation, could be satisfied by the data package received with the application;
  4. Determine if the EPM or DAPM content requirements of AWM Chapter 505 sections 505.107, 505.207, or 505.407, as appropriate to the requested delegation, could be satisfied by the EPM or DAPM received with the application;

Note:

A sample application checklist is provided in Appendix B, Table B1, which can be used to develop a checklist for determining if all required data/documentation has been included with the application to show compliance with the requirements defined in paragraphs 5.2(c) and (d) of this ACSI.

  1. If it has been determined that the data package is inadequate to support review of the application, the OPI shall advise the applicant and discuss the documentation requirements to make sure that they are understood. Once the revised data package has been received, that should now meet the requirements of AWM Chapter 505, the approval process can continue; and
  2. When all supporting documents have been received from the applicant the OPI should determine which Transport Canada specialists will be required to participate in the review. The OPI will determine if both Engineering and Flight Test specialists are required and will coordinate their participation. Regional OPIs will coordinate HQ specialist participation through the Delegations and Quality Division (AARDL), which will make sure that the required Division Chiefs can support participation in the review by their personnel. While multiple specialists may participate in the review, the OPI will remain the focal point for the review and determination of suitability of the applicant.
4.3 Application Assessment and Debrief

Application assessment is part of the approval process that is completed to ensure that an applicant meets the personnel qualification requirements and EPM or DAPM content requirements specified in AWM Chapter 505, appropriate to the requested delegation. Any concerns noted during the review are discussed with the applicant to make sure that they are resolved and any required if delegation cannot be granted. The following subsections expand on the process.

4.3.1 Applicant Qualifications and Manual Review

4.3.1.1 The OPI is responsible for reviewing the EPM or DAPM for technical, procedural, or policy content and for identifying any concerns or questions with the manual. As required, the OPI may request specialist review of specific sections of the manual if there is a question on the technical or procedural content. Review of the applicant's EPM or DAPM will be against the respective requirements in AWM Chapter 505, sections 505.107, 505.207, or 505.407, as applicable to the application, as well as additional information on manual content that can be obtained from both AMA 505C/1 and ACSI No. 52. To support this assessment an AWM Chapter 505 Compliance Checklist can be used to make sure that an applicant's EPM or DAPM contains the information stipulated in sections 505.105 and 505.107 for an AEO, in sections 505.205 and 525.207 for a DAR, or in sections 505.405 and 505.407 for a DAO. This checklist can be enhanced as desired to capture other pertinent information. A sample DAR Engineering Procedures Manual Checklist is provided in Appendix B, Table B2.

4.3.1.2 The specialist's review will determine if the applicant meets the personal qualification requirements and level of experience specified in AWM Chapter 505, sections 505.109, 505.203, or 505.409, and the criteria specified in ACSI No.'s 49, 50, and 51, as appropriate. The specialist(s) will determine if the requested Scope of Authority is appropriate to the applicant's qualifications and experience. A sample DAR Applicant Eligibility Checklist is provided in Appendix B, Table B3, which can be used to assist in the development of specific checklists by OPIs. ACSI No. 49 shall be consulted for guidance on personnel qualification criteria including acceptable qualification, knowledge, and experience required of an applicant nominated as a DE within a Delegated Organization. AMA 505C/1 shall be consulted for guidance on DAR applications.

4.3.1.3 The OPI is responsible to collate all specialist comments, and if warranted, convene an internal review meeting with the specialist(s) for a debriefing on their findings and to determine if further action is required to complete the assessment of potential for delegation. The OPI will make sure, if further action is required, that interviews are scheduled and other identified follow-up action is completed, which may include:

  1. An interview of the applicant by OPI and/or specialist(s);
  2. A request for further information or clarification of information provided; and
  3. A discussion with the Airworthiness Control Committee (ACC) or the Core Delegate with responsibility for the applicant, if the application is from a Delegated Organization.

4.3.2 Delegated Organization Approval Process Participation

4.3.2.1 The provisions of section 3.3 of ACSI No. 45 allow that a Delegated Organization, which has a Core ACC may nominate DEs and, subject to the provisions of their approved EPM or DAPM, may authorize DEs who are to become Regular Members of the ACC. The approved EPM or DAPM must contain procedures that specify the approval and authorization process. A Delegated Organization can find guidance for the development of these procedures in ACSI No. 50, which discusses authorization of Delegates. Membership in the Core ACC is determined solely by TCCA and all nominations for membership in the Core ACC will be reviewed by TCCA and eligible DEs will be authorized by Transport Canada as Core Members.

4.3.2.2 Aircraft Certification personnel reviewing DE applications received from a Delegated Organization with a Core ACC as discussed in paragraph 4.3.2.1, may deviate from the approval process presented in this ACSI. To allow this deviation in the approval process there must be an approved, equivalent process in the applicant's EPM or DAPM that defines how the Core ACC will complete the approval process. Aircraft Certification personnel may take into account, as part of their approval process, the review completed by the Core ACC members of a Delegated Organization if the application review findings and recommendations have been documented.

4.3.2.3 The provisions of ACSI No. 45 further allow that Delegated Organizations with a Core ACC, subject to the provisions of their approved EPM or DAPM, may also approve certain revisions to their EPM or DAPM if the revisions do not affect the approved Scope of Authority or procedures of the Delegated Organization. Revisions to an approved EPM or DAPM that incorporate a Letter of Authorization or the Scope of Authority defined in the Letter of Authorization of a new DE may not require additional review or approval by Transport Canada if this is identified in the approved EPM or DAPM.

4.3.3 Delegation Decision

On completion of the application assessment the OPI shall:

  1. Based on the review of the supporting documentation and interview with the applicant the specialist(s) may recommend to the OPI that Transport Canada not authorize the applicant based on a determination that the applicant does not meet the requirements of AWM Chapter 505. It is the OPIs responsibility to advise the applicant of the reason(s) for the decision not to delegate, and inform them of the steps they should take before reapplying in the future.
  2. If the applicant meets the requirements for delegation, the OPI shall obtain a designation number from the Delegations and Quality Division (AARDL) for the applicant. The OPI shall make sure that a written copy of comments is provided to the applicant for review and disposition and that the applicant has been advised of the designation number. Disposition of each comment shall be documented for follow-up tasks and future reference, and placed on the applicant's file.
  3. If required, the applicant shall revise the EPM or DAPM accordingly and resubmit for approval along with the responses to any other comments identified by the OPI. If no comments were raised during the review, or the internal meeting determined that the comments were not significant enough to warrant a manual revision, then Transport Canada may proceed with approval of the EPM or DAPM. If the application is for a DAR, the applicant is advised of their delegate designation number for incorporation into their EPM and the need to forward a signed copy to Transport Canada for signature on the EPM Approval Page. If the application is for a delegate within a Delegated Organization, they will be advised of the requirement to incorporate the information on the applicant's scope and designation number in the next revision of the manual.
  4. Based on input received from the specialist(s), the OPI shall prepare a Letter of Authorization as outlined in ACSI No. 48. The Letter of Authorization will assign a Designation Number to the applicant and may include an appendix detailing the Scope of Authority. It is the applicant's responsibility to review this letter and to acknowledge their acceptance of the responsibilities and limitations associated with the delegation by signing the Letter of Authorization in the signature block, and returning a copy to Transport Canada.

 

 

 

 

 

5.0 Delegate Authorization Process

The Delegate authorization process consists of the completion of all pertinent documentation required to authorize a Ministerial Delegation.

5.1 Means of Authorization

5.1.1 The means of authorizing a Ministerial Delegation is through the issuance of a Letter of Authorization to DARs, and to DEs in a Delegated Organization. Changes to the Scope of Authority of a Delegate will require the issuance of a new Letter of Authorization that fully describes the current Scope of Authority.

5.1.2 Newly authorized DARs will also receive a Certificate of Authorization, which they should display at their ordinary place of work. The certificate is not reissued if there is a change in scope of the Delegate as the certificate only shows that the DAR is a Ministerial Delegate and does not show a level of delegation.

5.2 Signatures

The External Ministerial Delegation of Authority Document No. 146456 states that only the Airworthiness Director, and the Chiefs of Engineering and Flight Test are delegated to authorize DAOs, AEOs, or DARs. This document does not presently reflect the role that the RMACs have in the authorization of Delegates, including the preparation of Letters of Authorization, Certificates of Authorization, and the signing of EPM or DAPM Approval Pages. Pending publication of a revised External Ministerial Delegation of Authority Document to replace that of June 7, 1996 the following guidelines will define who shall sign the various documents used to authorize Ministerial Delegates:

  1. New EPM or DAPM Approval Pages (original issue) shall be signed by the Director, Aircraft Certification or "the person designated to act for him/her in his/her absence", per Schedule 4 of the External Ministerial Delegation of Authority Document;
  2. Revisions to previously approved EPMs or DAPMs for Delegated Organizations managed by a Region shall be signed by the RMAC, with no requirement for copies of these EPMs or DAPMs to be sent to HQ. For those Delegated Organizations managed by HQ, the Director, Aircraft Certification shall sign the revised EPM or DAPM;
  3. All Letters of Authorization (originals or revisions) shall be signed by the Director, Aircraft Certification or "the person designated to act for him/her in his/her absence", per Schedule 4 of the External Ministerial Delegation of Authority Document; and
  4. All Certificates of Authorization shall be signed by the Director, Aircraft Certification or "the person designated to act for him/her in his/her absence", per Schedule 4 of the External Ministerial Delegation of Authority Document.
5.3 Actions After a Change to the Scope of Authority

5.3.1 All changes in the Scope of Authority require the issuance of a revised Letter of Authorization, updating of the Delegations Information System (DIS) database, and may require revision of the approved EPM or DAPM depending on how the Scope of Authority was defined in the manual. Revised Letters of Authorization and approval of manual revisions will be signed as per the guidelines in paragraph 5.2 above. To simplify the definition and control of a Delegate's Scope of Authority after a change, the Letter of Authorization shall be revised to completely define the current Scope of Authority so that there is no requirement to point to previous Letters of Authorization.

5.3.2 The Delegations and Quality Division (AARDL) will make sure that changes in a Delegate's Scope of Authority are published so that Aircraft Certification personnel are aware of the change. While this information is available for users in HQ through the DIS database, it is not accessible to Regional personnel. Notice will be provided to RMACs through the electronic mail system until this shortcoming has been corrected.

5.3.3 A change in the Scope of Authority of a Delegate that results in the suspension or surrender of a delegation requires that the Delegate return the Letter of Authorization to Transport Canada. In the case of a DAR, they are to return both their Letter and Certificate of Authorization. The Canadian Aviation Regulations (CARs) under section 103.03 "Return of Canadian Aviation Documents", requires that when a Canadian Aviation Document has been canceled, the person to whom it was issued shall return it to the Minister immediately following the effective date of the cancellation.

 

 

 

 

 

6.0 Administrative Activities

On determining that the standards for Ministerial Delegation have been complied with, there are a number of administrative activities that shall be completed for each new Delegate, or Delegate with a revised Scope of Authority.

6.1 Letter of Authorization

The Letter of Authorization for all Delegates shall be prepared using the criteria and the sample letter presented in Appendix A of ACSI No. 48. A copy of the letter incorporating the proposed Scope of Authority shall be prepared and initialed by the OPI, review team members, and managers, as appropriate. This initialed letter shall be retained on the applicant's file. The Letter of Authorization shall be signed as defined in paragraph 5.2 above. All revisions to a Delegate's Scope of Authority require that a revised Letter of Authorization be prepared as per paragraph 5.3, and signed per paragraph 5.2 above.

6.2 Certificate of Authorization

All newly authorized DARs will receive a Certificate of Authorization in addition to their Letter of Authorization. The OPI will make sure that the Delegations and Quality Division (AARDL) has been provided with the proper name and designation number, and the date of authorization that should appear on the certificate. The certificate will be signed as defined in paragraph 5.2 above. The date appearing on the certificate under the authorizing signature will be the effective date of authorization for the DAR.

6.3 Updating the Delegations Information System (DIS) Database

The OPI shall provide the Delegations and Quality Division (AARDL) with an electronic copy of the Delegate's Letter of Authorization, scope, and contact information, so that they can update the database. The information subsequently published in the database shall be verified by the OPI to confirm that it is correct. The OPI shall make sure that any subsequent changes to a Delegate's contact information, scope, or Delegation status has been provided to the Delegations and Quality Division (AARDL) so that the database can be updated.

6.4 Distribution Lists

It is the responsibility of the Delegations and Quality Division (AARDL) to make sure that the names of all newly authorized Delegates are added to the:

  1. Delegates Newsletter distribution list;
  2. ACPL and ACSI distribution lists by providing the Regulatory Standards Division in HQ (AARDH) with copies of the Letters of Authorization and contact information; and
  3. Airworthiness Notice distribution list by providing the Continuing Airworthiness Division in HQ (AARDG) with copies of the Letters of Authorization and contact information.
6.5 Nametag Ordering

It is the responsibility of the Delegations and Quality Division (AARDL) to make sure that nametags have been ordered from the Chief of MultiMedia Products and Services (AARA-APD) for all newly authorized Delegates. A list that shows how the names should be presented on the nametag should be provided and the nametags should normally be ordered in groups of twelve or more.

6.6 Authorization to Publish Contact Information

It is the responsibility of the Delegations and Quality Division (AARDL) to make sure that a letter has been prepared and forwarded with the Letter of Authorization to all newly authorized DARs that requests that the applicant authorize Transport Canada to publish their name and contact information on the Transport Canada Internet website by signing and returning the letter. The letter shall include a copy of all the contact information that will be published on the Internet website so that the Delegate has the opportunity to review and revise it, as they deem appropriate. A copy of the signed letter shall be retained on the Delegate's file.

6.7 Document Distribution

It is the responsibility of the Delegations and Quality Division (AARDL) to make sure that documents authorizing the Ministerial Delegation (Letter of Authorization, Certificate of Authorization, and EPM or DAPM, as appropriate) are distributed to the Delegate or to the Region responsible for the Delegate. If responsibility for the Delegate is with a Region, the Region should provide instructions to the Delegations and Quality Division on how they want distribution of the documents to be handled, otherwise the documents will be forwarded to the Region for distribution.

6.8 Follow-up Activities

If there are any follow-up activities, conditions, or training that has been identified as part of the Letter of Authorization or through prior discussion and agreement with the applicant, the OPI will be responsible for ensuring that these follow up activities have been completed.

The use of separate checklists is recommended to ensure that the appropriate documentation has been sent (DAR Application File Pre-screening Checklist, Table B1), that the EPM or DAPM meet the respective requirements in AWM Chapter 505, section 505.107, or other chapter as appropriate (DAR Engineering Procedures Manual Checklist, Table B2), and that the eligibility requirements have been demonstrated (DAR Applicant Eligibility Checklist, Table B3). To obtain a delegation of authority as a DAR an applicant shall:
505.203(a) be a graduate in an engineering discipline from a recognized University or be registered or eligible for registration by a Provincial Association as a professional engineer in Canada or have knowledge and experience which, in the opinion of the Minister, is equivalent to the foregoing  
505.203(b) have, in the opinion of the Minister, a thorough knowledge gained by working experience of the applicable Canadian airworthiness requirements in his specialty and, where required, a thorough knowledge of Canadian operational requirements  
505.203(c) provide a service with respect to regulatory compliance of designs for aeronautical products in Canada  
505.203(d) have not less than a one year working relationship, satisfactory to the Minister, with the Department of Transport Airworthiness Branch Staff, in processing engineering information for the approval of an aeronautical product design  
505.203(e) have not less than six years of progressively more responsible related aeronautical engineering or flight test experience  
505.203(f) be a Canadian citizen or a permanent resident as defined in the Immigration Act and have an ordinary place of business in Canada  
505.203(g) in addition to 505.203 (a) through (f) the specialty of test pilot must: (1) have a current pilot's licence; (2) be a graduate of a recognized test pilot school or have, in the opinion of the Minister, an equivalent qualification gained through engineering test flying; and (3) have current experience acceptable to the Minister
