Exemption From Paragraph 704.108(1)(d) of the Canadian Aviation Regulations

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after having taken into account that the exemption is both in the public interest and is not likely to affect aviation safety, I hereby exempt Lmage Air Charter Inc., 2450 Derry Road East, Hangar 5, Bay 3, Mississauga, Ontario L5S 1B2, and Terry Tripp, Licence number AA344595, from the requirements of paragraph 704.108(1)(d) of the Canadian Aviation Regulations, subject to the conditions set out below.

The paragraph states that "...no air operator shall permit a person to act and no person shall act as a flight crew member in an aircraft unless that person has fulfilled the requirements of the air operator's ground training program and, except where undergoing line indoctrination training, the air operator's flight training program".

Purpose

The purpose of this exemption is to allow Mr.Terry Tripp, Licence number AA344595 to act as a flight crewmember on WestWind (WW24) aircraft, operated by Image Air Charter Inc. without completing line indoctrination training.

Application

This exemption applies to Mr. Terry Tripp of Image Air Charter Inc., when operating a WestWind (WW24) aircraft, Registration No., C-GHYD, under Air Operator Certificate Number 9548.

Conditions

This exemption is subject to the following conditions:

  1. Mr. Tripp will have completed all training requirements in accordance with Lmage Air Charter Inc.'s approved training program, exclusive of line indoctrination training.
  2. This exemption shall become part or Mr. Tripp's training record.
  3. The Director of Operations will be required to personally release the aircraft to ensure that all required documentation is completed and that the flight will be conducted in accordance with the COM and the Canadian Aviation Regulations (CARS). The documentation should be copied to the POI.

Validity

This exemption is in effect until the earliest of:

  1. EST at midnight on May 11, 2005;
  2. the date on which any of the foregoing conditions is not complied with; or
  3. the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest or that it is likely to affect aviation safety.
