EXEMPTION FROM PARAGRAPHS 605.18(a), (b) and (h) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after having taken into account that the exemption is both in the public interest and is not likely to affect aviation safety, I hereby exempt all persons conducting take-offs in an Agusta A109A, A109A2 and A109E rotorcraft from the requirements set out in paragraphs 605.18(a) (b) and (h) of the Canadian Aviation Regulations (CARs), subject to the conditions set out below.

Paragraphs 605.18 (a) and (b) state that no person shall conduct a take-off in a power-driven aircraft for the purpose of IFR flight unless it is equipped with, when it is operated by day, the equipment required pursuant to paragraphs 605.16(1)(a) to (h) and when it is operated by night, the equipment required pursuant to paragraphs 605.16(1)(a) to (k).

Paragraph 605.18 (h) states that no person shall conduct a take-off in a power-driven aircraft for the purpose of IFR flight unless it is equipped with an alternative source of static pressure for the altimeter, airspeed indicator and vertical speed indicator.

Purpose

The purpose of this exemption is to permit all persons conducting take-offs in an Agusta A109A, A109A2 and A109E rotorcraft to do so without the rotorcraft being equipped with an alternative source of static pressure for the vertical speed indicator.

Application

This exemption applies to all persons when conducting take-offs in an Agusta A109A, A109A2 and A109E rotorcraft, which are certified in Transport Canada Type Certificate and Type Certificate Data Sheet H-82. 

Conditions

This exemption is subject to the following conditions:

  1. The Agusta A109A, A109A2 and A109E rotorcraft must be the subject of a valid Type Certificate and Certificate of Airworthiness;
  2. The aircraft must be operated in accordance with the specifications in the Rotorcraft Flight Manual; and
  3. All requirements in paragraphs 605.18(a) (b) and (h) of the Canadian Aviation Regulations (CARs) not related to the specific purpose of this Ministerial exemption shall remain applicable when conducting take-offs in an Augusta A109A, A109A2 and A109E rotorcraft.

Validity:

This exemption is in effect until the earliest of the following:

  1. The date on which any condition set out in this exemption is breached; or
  2. The date on which this exemption is cancelled, in writing, by the Minister where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.
