Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Helijet International Inc., 5911 Airport Road South, Richmond, BC, V7B 1B5 from the requirements of section 507.07 of the Canadian Aviation Regulations (CAR), subject to the conditions listed below.
Section 507.07 stipulates “Where an application for a flight authority is made in respect of an aircraft being imported, the applicant must comply with the importation requirements specified in Chapter 507 of the Airworthiness Manual”.
PURPOSE
The purpose of this exemption is to permit Helijet International Inc. to operate a Bombardier Lear 31A aircraft, serial number 120, which does not satisfy paragraph 507.07. Specifically, some of the aircraft modifications unique to Canadian registered Lear 31A aircraft cannot be acquired and installed at this time because parts are not available.
APPLICATION
This exemption applies to Bombardier Learjet 31A aircraft, registration C-GHJU, serial number 120, when operated by Helijet International Inc., 5911 Airport Road South, Richmond, BC, V7B 1B5, in its operation under Air Operator Certificate Number 10379.
CONDITIONS
This exemption is subject to the following condition:
- The aircraft shall be operated in accordance with
- a) FAA approved Learjet 31A Flight Manual FM-121 dated July 25 1991, at change 4, or later approved revision,
- b) Transport Canada approved Learjet 31A Airplane Flight Manual Supplement AFMS W1239, and
- c) Transport Canada approved Helijet International Inc. Learjet 31A Flight Manual Supplement HJI-LR31A-0001, original issue, dated April 4, 2007, or later Transport Canada approved revision.
VALIDITY
This exemption is in effect until the earliest of the following:
- a) 23:59 Pacific Standard Time on October 5, 2008;
- b) the date on which both Learjet Inc. ECR 3186 and Belly Skid installations are accomplished;
- c) the date on which any of the conditions set out in this exemption is breached;
- d) the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest or that it is likely to affect aviation safety.
