EXEMPTION FROM SECTION 521.158 OF THE CANADIAN AVIATION REGULATIONS ONLY WITH RESPECT TO PARAGRAPH 25.813(e) OF THE UNITED STATES OF AMERICA FEDERAL AVIATION REGULATIONS (FAR) PART 25.

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt WestJet, 22 Aerial Place NE, Calgary, Alberta, T2E 8X7, an air operator, from the requirements of clause 705.124(2)(b)(iv)(C) of the Canadian Aviation Regulations (CARs) and paragraphs 7.8.5(a) (Initial) and 7.6.8(a) (Annual) of the Flight Attendant Training Standard (TP12296) made pursuant to paragraph 705.124(1)(b) of the CARs, subject to the conditions set out below.

Subsection 705.124(1)(b) stipulates that every air operator shall establish and maintain a training program in respect of flight attendants, approved in accordance with the Commercial Air Service Standard (CASS) and the Flight Attendant Training Standard.

Clause 705.124(2)(b)(iv)(C) stipulates that an air operator’s training program shall include, in respect of flight attendants, initial and annual training, including emergency procedures training.

Paragraph 7.8.5(a) (Initial) of the Flight Attendant Training Standard states; “Each trainee shall demonstrate the effectiveness of a fire extinguisher correctly applied to an actual fire while wearing a P.B.E”.  Paragraph 7.6.8(a) (Annual) of the Flight Attendant Training Standard states; “Once every third annual training year, each crew member shall demonstrate the effectiveness of a fire extinguisher correctly applied to an actual fire while wearing a P.B.E”.

PURPOSE

The purpose of this exemption is to allow WestJet to conduct its live fire fighting training without the requirement for each trainee to wear protective breathing equipment (P.B.E.).

APPLICATION

This exemption is applicable only to WestJet’s flight attendant training programs.

CONDITIONS

This exemption is subject to the following conditions:

  1. WestJet shall ensure each trainee wears a P.B.E. during the cabin fire fighting drills required by Initial, Sections 7.8.6 and 7.8.8 of the Flight Attendant Training Standard
  2. WestJet shall ensure each trainee wears a P.B.E. at least once every three years, during the cabin fire fighting drills required by Annual, Section 7.6.4 and 7.6.7 of the Flight Attendant Training Standard.
  3. WestJet shall amend its flight attendant training programs to include conditions 1 and 2.

VALIDITY

This exemption is in effect until the earliest of the following:

  1. April 1, 2013 at 23:59 EST;
  2. the date on which any of the conditions set out in this exemption is breached; or
  3. the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it no longer in the public interest, or that it is likely to affect aviation safety.
