EXEMPTION FROM SUBPARAGRAPH 703.07(2)b)(ii) OF THE CANADIAN AVIATION REGULATIONS AND subdivision 723.07(2)b)(i)(B) OF THE COMMERCIAL AIR SERVICE STANDARDS - HELICOPTERS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Héli-Boréal Inc., 130 Chambers, Sept-Îles, Quebec, G4R 4W7 from the requirements of subdivision 723.07(2)b)(i)(B) of the Commercial Air Service Standards (CASS), which arises under subparagraph 703.07(2)b)(ii) of the Canadian Aviation Regulations (CARs), under the following conditions.

Subparagraph 703.07(2)b)(ii) of the CARs stipulates that air operators shall employ chief pilots who have been approved by the Minister in accordance with the CASS.

Subdivision 723.07(2)b)(i)(B) of the CASS stipulates that the chief pilot shall have at least 500 hours flight time of which 250 hours shall be as pilot-in-command within the preceeding 3 years on the same category and class of aircraft being operated.

Purpose

The purpose of this exemption is to authorize Héli-Boréal Inc., 130 Chambers, Sept-Îles, Quebec, G4R 4W7, under Part VII, Subpart 3 of the CARs, to use a chief pilot who met the requirements at the time of the initial appointment, but does not have 250 hours flight time as a pilot-in-command within the preceding 3 years on the same category and class of aircraft being operated.

Application

This exemption applies to Héli-Boréal Inc., 130 Chambers, Sept-Îles, Quebec, G4R 4W7, which is employing a chief pilot who met the requirements at the time of his initial appointment, but does not meet the requirement of 250 hours flight time as a pilot-in-command within the preceding 3 years on the same category and class of aircraft being operated.

Condition

This exemption applies under the following condition:

Upon his initial appointment of chief pilot at Héli-Boréal Inc., 130 Chambers, Sept-Îles, Quebec, G4R 4W7, the candidate must have acquired at least 500 hours flight time, and have passed a Transport Canada PPC on the same category and class of aircraft being operated.

Validity

This exemption is in effect until the earliest of the following:

  1. February 1, 2007 at 23:59 p.m. (EST);
  2. the date on which the condition set out in this exemption is breached;
  3. the date on which this exemption is cancelled, in writing, by the Minister, where he is of the opinion it is no longer in the public interest or is likely to affect aviation safety.
