EXEMPTION FROM SUBSECTION 401.13(1) OF THE CANADIAN AVIATION REGULATIONS AND SUBSECTIONS 421.13 (3) and (4) OF STANDARD 421 FLIGHT CREW PERMITS, LICENCES AND RATINGS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety I hereby exempt all hereafter listed foreign Chinese students who are enrolled with Montair Aviation Inc. (hereafter referred to as the applicants), 7673 Garfield Drive, Delta, B.C., V4C 4E6, from the requirement set out in subsection 421.13(3) and paragraph 421.13(4)(f) of the Personnel Licensing and Training Standards Respecting Flight Crew Permits, Licences and Ratings, made pursuant to subsection 401.13(1) of the Canadian Aviation Regulations (CARs), subject to the conditions set out below.

The requirements of section 401.13 of the Canadian Aviation Regulations and subsection 421.13(3) and paragraph 421.12(4)(f) of the Personnel Licensing and Training Standards Respecting Flight Crew Permits, Licences and Ratings are detailed in Appendix A of this exemption.

Purpose

The purpose of this exemption is to permit the hereafter listed Chinese foreign students holding Canadian Commercial Pilot Licences in the Aeroplane category and enrolled in a flight training course conducted by Montair Aviation Inc. to complete the SAMRA and SARON written examinations whithout complying with the requirement of having completed 750 hours of flying training experience as required and without having to produce the letter of recommendation within 60 days prior to the date of the written examination, pending the coming into force of the Integrated Commercial Course regulatory proposal.

Application

This exemption applies to all the hereafter listed Chinese foreign students holding Canadian Commercial Pilot Licences (referred to as the applicants), enrolled in a Montair Aviation flight training course, wishing to complete the SAMRA and SARON written examinations in accordance with CAR 421.34 (4)):

Conditions

This exemption is subject to the following conditions:

  1. The applicants shall hold a valid Canadian Commercial Pilot Licence in the Aeroplane category, endorsed with a multi-engine class rating and instrument rating;
  1. The applicants shall have completed a minimum of 240 hours of flying training experience prior to attempting the written examinations;
  1. The applicants shall, to be eligible to write the SAMRA and SARON written examinations, produce a letter of recommendation from the responsible Montair flight instructor, dated within 30 days prior to the date of the written examination; and
  1. The completion of the SAMRA and SARON written examinations will not result in the issue of a Canadian Airline Transport Pilot Licence.
Validity

This exemption shall be in effect until the earliest of:

  1. January 31, 2007, at 23:59 EST;
  2. the date on which the amendment introducing the Integrated Course regulatory requirements to the appropriate provision of the Canadian Aviation Regulations and associated standard comes into effect;
  3. the date on which any condition set out in this exemption is breached; or
  4. the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest or is likely to affect aviation safety.

Appendix A

SUBSECTION 421.13 (3) and (4) OF STANDARD 421 FLIGHT CREW PERMITS, LICENCES AND RATINGS MADE PERSUANT TO

SECTIONS 401.13 OF THE CANADIAN AVIATION REGULATIONS

Subsection 401.13(1) of the CARs states that prior to taking a written examination, an applicant for a flight crew permit, licence or rating shall meet the prerequisites for the examination set out in the personnel licensing standards with respect to medical fitness; identification; a recommendation from the flight instructor who is responsible for the training of the applicant, and experience.

Subsection 421.13(3) of the Standard 421 Flight Crew Permits, Licences and Ratings, Examination Prerequisites, states that to be eligible to write the examination required for the issue of a permit, licence or rating, the candidate shall produce the following letter of recommendation dated within 60 days prior to the date of the written examination: (a) an applicant for a Pilot Permit - Gyroplane, Private Pilot Licence, or Commercial Pilot Licence shall provide a letter of recommendation from the Flight Training Unit or from the flight instructor who is responsible for the training of the applicant, stating that the applicant has completed the ground school instruction, and has reached a sufficient level of knowledge to write the examination; …

Paragraph 421.13(4)(f) of the Standard 421 Flight Crew Permits, Licences and Ratings, Examination Prerequisites, states in part that to be eligible to write the examination required for the issue of a permit, licence or rating, the candidate shall provide proof that the experience and training requirements set out below have been met: all other applicants shall have a minimum of fifty percent (50%) of the total flight experience for the issue of the permit, licence, or rating.
