Exemption from subsection 573.02 (11) of Standard 573-Approved Maintenance Organizations made pursuant to subsection 573.02(2) of the Canadian Aviation Regulations

NCR-007-2020

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to adversely affect aviation safety, I hereby exempt Approved Maintenance Organization (AMO) certificate holders with rating(s) in the Avionics, Instrument and Component categories from complying with subsection 573.02 (11) of Standard 573 — Approved Maintenance Organizations made pursuant to subsection 573.02(2) of the Canadian Aviation Regulations (CARs), subject to the following conditions.

Subsection 573.02(11) of Standard 573 states that an AMO with ratings in the Aircraft, Avionics, Engine, Propeller, Structure, or Component categories may evaluate undocumented parts of the kinds listed on the pertinent ratings, provided that:

  • a) the AMO establishes applicable procedures in its Maintenance Policy Manual, to perform the process outlined in Standard 571, Appendix H;
  • b) the AMO obtains approval for the procedures required in paragraph (a) in accordance with section 573.01 of the CARs; and
  • c) the performance of such service is authorized in the limitations set out in the AMO certificate.

Subsection 573.02(2) of the CARs states that the AMO certificate shall specify, in accordance with the criteria specified in section 573.02 of Standard 573 — Approved Maintenance Organizations, any category in which ratings have been issued and shall list the aeronautical products that the AMO is authorized to maintain or the maintenance services that the AMO is authorized to perform.

Purpose

This exemption relieves AMOs with ratings in the Avionics, Instrument and Component categories from the requirements of subsection 573.02(11) of Standard 573. They will not be required to have procedures for the evaluation of undocumented parts outlined in Appendix H of Standard 571 approved in their Maintenance Policy Manual.

Application

The exemption applies specifically to AMO certificate holders in the Avionics, Instrument and Component categories, issued pursuant to Part V Subpart 73 of the CARs when recertifying undocumented parts. This exemption does not apply to AMO certificate holders in the Aircraft, Structure, Engine and Propeller categories.

This exemption ceases to apply to an AMO certificate holder with ratings in the Avionics, Instrument and Component categories when breaching a condition of the exemption.

Conditions

This exemption is subject to the following conditions:

  1. The AMO certificate holder with ratings in the Avionics, Instrument or Component categories shall ensure that the parts recertified are within the applicable scope of those ratings;
  2. The AMO certificate holder with ratings in the Avionics, Instrument or Component categories shall have available the necessary maintenance manual or instructions for continued airworthiness (ICA) to maintain those parts in accordance with Subpart 571 of the CARs;
  3. The AMO certificate holder with ratings in the Avionics, Instrument or Component categories shall comply with all other requirements of the Canadian Aviation Regulations.

Validity

This exemption will be in effect from February 18, 2020 until the earliest of the following:

  • a) February 17, 2022 at 23:59 EST;
  • b) the date on which an amendment to the Canadian Aviation Regulations or related Standards, modifying the subject-matter specifically addressed in this exemption, comes into effect; or
  • c) the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest, or is likely to adversely affect aviation safety.
