Schedule of Conditions -EXEMPTION FROM SUBSECTION 700.02(1) AND SECTION 702.02 OF THE CANADIAN AVIATION REGULATIONS

  1. No change in the operation or type of aircraft shall be made by the air operator, except in the case of emergency, without first obtaining the authorization from the Minister.
  2. Where a change in the operation or type of aircraft is made in a case of emergency as specified in condition 1, the air operator shall notify the Minister of the change made within a reasonable time following the change.
  3. Operations permitted by this exemption shall be subject to the performance limitations contained in the aircraft flight manual approved by the air operator’s civil aviation authority associated with the aircraft type certificate and certificate of airworthiness for the aircraft being operated.
  4. All flights will be conducted in DAY VFR conditions in the National Research Council designated Flight Test Area at the MacDonald-Cartier International Airport during the period January 14, 2004 to March 31, 2004.
  5. When an aircraft conducting operations permitted by this exemption is to be operated under a flight authority, other than a standard Certificate of Airworthiness that meets the requirements of Article 31 of the Convention to ICAO, the air operator shall obtain a flight authority validation from the Minister prior to commencing operations.
  6. When an aircraft is operated in Canadian airspace, a copy of the flight authority validation required in condition number 5, in addition to a copy of the flight authority, shall be carried on board the aircraft.
  7. This exemption is valid only while the air operator is in possession of a valid flight permit, certificate, licence or other satisfactory document from the air operator's own state of registry authorizing the operations for which this temporary authority is granted.
  8. The air operator shall comply with the Transportation of Dangerous Goods Act, 1992 and Regulations and shall obtain any necessary permits while carrying dangerous goods pursuant to this exemption.
  9. Nothing in this exemption relieves the air operator from compliance with the provisions of any Canadian aviation documents that have been issued pursuant to the Aeronautics Actt.
  10. When directed by Transport Canada, the air operator shall make the aircraft available for inspection by Civil Aviation Inspectors, at a specific time and location, in accordance with the Aeronautics Actt and the Canadian Aviation Regulations.
  11. No persons shall be carried on board the aircraft except those essential crew members required to accomplish the aerial work and authorized in accordance with the permissions and exemptions issued to Associated Aircraft Group, Inc. by its civil aviation authority.
  12. A copy of this exemption shall be carried on board the aircraft while operating in Canada.
