EXEMPTION FROM SUBSECTIONS 5.2.9.4, 5.2.9.5 and 5.2.9.7 of THE AERODROME STANDARDS AND RECOMMENDED PRACTICES (TP 312E, 4th Edition) AND SUBPARAGRAPHS 302.07(1)(a)(i) and (ii) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt all Canadian Airports Operators, from the requirements of subsections 5.2.9.4, 5.2.9.5 and 5.2.9.7 of The Aerodrome Standards and Recommended Practices (TP 312E, 4th Edition) made pursuant to subparagraphs 302.07(1)(a)(i) and (ii) of the Canadian Aviation Regulations, subject to the following conditions.

Subsection 5.2.9.4 stipulates that at an intersection of a taxiway and a non–instrument, non–precision approach, precision approach category I or take–off runway, the taxi–holding position marking shall be as shown in Figure 5–6, pattern A.

Subsection 5.2.9.5 stipulates that where a single taxi-holding position is provided at an intersection of a taxiway and a precision approach runway category II or III, the taxi–holding position marking shall be as shown in Figure 5–6, pattern A. Where two or three taxi–holding positions are provided at such an intersection, the taxi–holding position marking closest to the runway shall be as shown in Figure 5–6, pattern A and the markings furthest from the runway shall be as shown in Figure 5–6, pattern B.

Subsection 5.2.9.7 stipulates that the taxi–holding position marking displayed at a runway/runway intersection shall be as shown in Figure 5–6, pattern A.

Purpose

The purpose of this exemption is to allow Canadian airports operators to double the width of all lines of the taxi-holding position markings of pattern A as shown in Figure 5-6 of The Aerodrome Standards and Recommended Practices (TP 312E, 4th Edition), in accordance with the provisions of Annex 14, Volume I, of the Convention on International Civil Aviation pending formal amendment of the standards.

Application

This exemption applies to all Canadian airports operators in order to double the width of all lines of the taxi-holding position markings of pattern A as shown in Figure 5-6 of The Aerodrome Standards and Recommended Practices (TP 312E, 4th Edition), in accordance with the amendment to Annex 14 of the Convention on International Civil Aviation.

Conditions

The exemption shall be subject to the following conditions:

  1. The taxi-holding position marking shall be:
    1. yellow in colour;
    2. outlined with a 15cm black paint border along all yellow paint edges as shown in Figure 1.0; and
    3. painted with the dimensions specified in Figure 1.0.
  2. Where more than one (1) taxi-holding position marking is provided at an intersection of a taxiway and a runway, such as for category II or III approaches, the additional taxi-holding position markings shall be as shown in Figure 5–6, pattern B of The Aerodrome Standards and Recommended Practices.
  3. A copy of the exemption document shall be inserted in the Airport Operations Manual.

Validity

This exemption is in effect until the earliest of the following:

  1. the date on which any of the condition set out in this exemption is breached;
  2. the date on which an amendment to the appropriate provisions of the Canadian Aviation Regulations and related standards comes into effect; or
  3. the date on which the exemption is cancelled by the Minister, in writing, where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.
