8.4.2 (1) Subject to subsections (2) and (3), no person shall transport dangerous goods that are included in Class 2 and are contained in a cylinder or other small container or in a tube, other than an aerosol or a flask containing an unpressurized refrigerated liquid, unless the applicable requirements of Canadian Standards Association Standard CSA-B340-97, Selection and Use of Cylinders, Spheres, Tubes, and Other Containers for the Transportation of Dangerous Goods, Class 2, dated July 1997, are complied with, except for the requirements of section 9.1.1.1 of CGA publication S-1.1, referred to in clause 4.3.1 of the Standard. (2) Notwithstanding the requirements of clauses 4.1.1, 5.1.3 and 5.1.4 of the Standard referred to in subsection (1), no person shall transport a cylinder or tube containing dangerous goods, other than a cylinder or tube from which the dangerous goods have been removed to the maximum extent possible, unless the cylinder or tube was manufactured in accordance with the requirements of

(a) National Standard of Canada CAN/CSA-B339-96, Cylinders, Spheres, and Tubes for the Transportation of Dangerous Goods, dated July 1996; or SOR / 98-371

(b) where the initial test date of the cylinder or tube is December 31, 1992 or earlier,

(i) the regulations for the transportation of dangerous goods by rail in force before December 5, 1991, or the conditions of any permit issued pursuant thereto, and the cylinder or tube has displayed on it the letters «CRC», «BTC», «CTC» or «TC», or

(ii) CFR 49, or an exemption in respect of packaging and handling issued pursuant to Subpart B of Part 107 of CFR 49, and the cylinder or tube has displayed on it the letters «ICC» or «DOT» and was in use in Canada before January 1, 1993.

(3) Dangerous goods that are included in Class 2 and that are contained in a cylinder or tube shall be transported according to the selection and use requirements

(a) of a permit referred to in subparagraph (2)(b)(i), if the cylinder or tube was manufactured in accordance with

(i) the conditions of the permit, or

(ii) both the conditions of the permit and the requirements of an exemption referred to in subparagraph (2)(b)(ii); or

(b) of an exemption referred to in subparagraph (2)(b)(ii), if the cylinder or tube was manufactured in accordance with the requirements of that exemption. [SOR / 95-547]
