1. Policy Objective

 

 

1.1 The purpose of this document is to allow an additional option for holders of Fishing Master, Second Class (CFV2), certificate of competency (CoC) originally issued between March 21, 1980 and June 30, 2007 to obtain the Fishing Master, First Class (FM1) certificate of competency issued under the Marine Personnel Regulations (MPR).

2. Policy Statement

2.1 In order to ensure a smooth transition with the Marine Personnel Regulations ( MPR ) and the International Convention on Standards of Training, Certification and Watchkeeping for Fishing Vessel Personnel (STCW-F), 1995, the department of Transport Canada Marine Safety ( TCMS ) allows an additional option for holders of Fishing Master, Second Class, certificate of competency originally issued between March 21, 1980 and June 30, 2007 to obtain the Fishing Master, First Class certificate of competency issued under the Marine Personnel Regulations. This will permit the holder’s to transit to the superior certificate by recognizing their acquired experience and the original validity of their CFV2 CoC.

2.2 To obtain the Fishing Master, First Class certificate under the MPR, the holders of Fishing Master, Second Class, certificate of competency originally issued between March 21, 1980 and June 30, 2007 must meet the following requirements:

2.2.1 While holding at least a Fishing Master, Third Class (CFV3 or FM3) certificate, have acquired 12 months of sea service as master or officer in charge of the navigational watch on board one or more fishing vessels of at least 25 gross tonnage or at least 12 meters that are engaged on unlimited voyages or near coastal voyages, class 1.

Note: Despite subsection 2.2.1, up to half the amount of an applicant’s sea service required by that subsection, may include service on board one or more normal trading vessels of at least 25 gross tonnage or at least 12 meters that are engaged on unlimited voyages or near coastal voyages, class 1.

2.2.2 In addition, have acquired the following sea service as master or officer in charge of the navigational watch:

  1. At least twelve months of sea service on board one or more fishing vessels within the five years before the application date; or
  2. At least three months of sea service on board one or more fishing vessels within the 12 months immediately before the application date.

2.2.3 Hold a valid medical certificate or a valid provisional medical certificate.

2.2.4 Complete with success the following examinations:

  1. Ship Construction and Stability, Level 2;
  2. General Ship Knowledge, Level 2; and
  3. Celestial Navigation, Level 1.

2.3 Validity of the Fishing Master, First Class certificate:

2.3.1 The holder of this certificate may act as master of a fishing vessel of any tonnage engaged on an unlimited, near coastal or sheltered waters voyage.

2.3.2 The Fishing Master, First Class certificate of competency is valid for a five-year period from the date of issue and the renewal requirements will be as per section 106 and 111 of the MPR .

3. Scope

3.1 This policy applies only to holders of Fishing Master, Second Class (CFV2), certificates of competency originally issued between March 21, 1980 and June 30, 2007.

4. Authority

4.1 This policy comes under the overall administrative authority of the Director General, Marine Safety and the Marine Safety Executive.

5. Responsibility

5.1 The Director, Personnel Standards and Pilotage, is responsible for this policy. Regional Directors are responsible for the application of the policy.

7. Background

7.1 The validity of the Fishing Master, Second Class certificate originally issued between March 21, 1980 and June 30, 2007 was:

  1. Master of a fishing vessel of any gross tonnage engaged on a voyage anywhere within the area around North America bounded by the meridians of longitude 30 degrees West and 180 degrees West and north of the parallel of latitude 6 degrees North;
  2. and as Chief Mate of a fishing vessel of any gross tonnage engaged on an unlimited voyage.

7.2 The validity of the Fishing Master, Second Class (FM2) certificate of competency issued under the Marine Personnel Regulations is lower than the validity of the CFV2 certificate originally issued between March 21, 1980 and June 30, 2007.

7.3 Canada has ratified the STCW-F Convention in June 2010. When this Convention comes into force, TCMS will have to exchange the existing CFV2 certificates for the STCW-F endorsed CoC. This means the holder of a Fishing Master, Second Class certificate originally issued between March 21, 1980 and June 30, 2007 will see the validity of his certificate lowered to:

  1. Master, limited waters;
  2. Master, fishing vessel of less than 24 meters, unlimited waters; and
  3. Officer, unlimited waters;
  4. Master of any type of vessels of less than 60 gross tonnage, near coastal, class 2.

7.4 Limited waters will be defined similarly to, or as Limited, Contiguous waters voyage.

7.5 TCMS is presently amending the MPR to reflect the STCW-F, 1995 Convention and the 2010 amendments of the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, 1978.

7.6 The holders of CFV2 that act as master on a fishing vessel in waters beyond the definition of the limited waters will need to obtain the FM1 CoC to operate their vessels. This policy will give them the opportunity to obtain the FM1 CoC without having to meet the full requirements of section 139 of the MPR.

7.7 The same opportunity was given to the holders of Master Intermediate voyage and First Mate Intermediate voyage CoC’s with the exchange table of Schedule 1 of Part 1 of the MPR.

8. Date of Application

8.1 This policy will enter into effect on October 1, 2011.

9. Date for Expiry

9.1 The provisions will expire when the Marine Personnel Regulations will be amended.
