The Marine Technical Review Board (MTRB) was created to replace the Board of Steamship Inspection regime when the Canada Shipping Act, 2001 came into force on July 1, 2007.
In July 2012, Transport Canada sent a letter to industry to explain that Section 270 of the Act says that decisions made by the Board of Steamship Inspection will expire five years after the Act came into force, so all decisions granted before July 1, 2007 had expired. The letter also assured Authorized Representatives that they would not be penalized during the decision renewal process.
In Phase 1, Transport Canada’s Marine Technical Review Board:
- reviewed thousands of decisions to determine which to renew, and
- informed Authorized Representatives when decisions were renewed and completed.
With Phase 1 of the Board of Steamship Inspection Renewal Project complete, Transport Canada is starting Phase 2. During Phase 2, we are reviewing all outstanding Board of Steamship Inspection decisions.
About Phase 2
Phase 2 of the Board of Steamship Inspection renewal project has started, and will continue for two years.
Year 1 –
- In 2015, Transport Canada will review vessel files to determine if there are any outstanding Board of Steamship Inspection decisions.
- During a vessel’s next scheduled inspection, the Transport Canada representative will recommend to the Authorized Representative, which Board of Steamship Inspection decisions the Marine Technical Review Board should renew to maintain the equivalency or exemption.
- For vessels not scheduled for inspection in 2015, the Transport Canada representative will inform the Authorized Representative of the results of the file review and identify decisions that may require renewal under the Marine Technical Review Board.
Year 2 –
- In 2016, Transport Canada will ask Authorized Representatives of vessels needing renewed Board of Steamship Inspection decisions, to ensure they have submitted their application for a decision renewal no later than September 1st 2016.
- It is intended, as of January 15, 2017, Transport Canada will not accept Board of Steamship Inspection decisions. The vessel may be subject to enforcement measures if not in compliance with regulations or exempted.
Roles of the Authorized Representative:
The Authorized Representative is responsible for ensuring a vessel owner applies for a Marine Technical Review Board decision in time to have the decision in place by December 31, 2016. This is why Transport Canada strongly recommends they submit all applications as early as possible, but no later than September 1, 2016.
IMPORTANT NOTE: If a vessel owner does not request a decision renewal, the Authorized Representative is responsible for ensuring that the vessel is in compliance with regulations.
