Problem:
During production the energy absorption foam material was omitted from the head contactable area on the back of the unit, contrary to the requirements of the Motor Vehicle Restraint and Booster Cushions Safety Regulations (RSSR) Schedule III, Subsection 6.
Background and Company Action:
Upon the investigation of a single public complaint it was determined that the energy absorption foam material had been omitted. The company was contacted and an internal investigation of the matter confirmed that the material was missing. The company has taken corrective action for consumers with the affected products and those within retail and company inventories.

Safety Risk:
The company has evaluated the situation and has determined that there is no safety risk. The company has not received any complaints concerning the crashworthiness performance of the restraint system due to the absence of the energy absorption foam in the head contactable area. Transport Canada is not aware of any complaints regarding this matter.
A total of two complaints have been received concerning alleged contusions in the lower back area on the children using the affected units. These were not the result of a motor vehicle collision. Transport Canada regards these complaints to be isolated discomfort problems and not a safety related issue.
The company has agreed to extend the foam padding from the head contactable area to the base to alleviate any potential for discomfort.
Consumers should continue to use the affected unit until they receive a retrofit kit.
Consumer Recourse:
The company has taken corrective action by making a free replacement foam kit available to consumers who have purchased an affected unit. In addition, the company has notified retailers to cease sales of the affected units until they have been modified.
Persons who have sent in registration cards will be sent the retrofit kit by Dorel Juvenile Group Customer Service Department. Those who have not sent in the registration cards should contact Dorel at 1-800-536-1090.
