In Canada, a person or business can be found guilty of an offence under the Motor Vehicle Safety Act, or regulations, and orders made under the act.
Transport Canada refers cases to the Public Prosecution Service of Canada who makes the final decision on whether or not to pursue a prosecution. They make this decision based on specific criteria, including whether they believe:
- there’s a reasonable prospect of conviction, and
- pursuing the prosecution is in the public interest
