Prosecutions under the Motor Vehicle Safety Act

In Canada, a person or business can be found guilty of an offence under the Motor Vehicle Safety Act, or regulations, and orders made under the act.

Transport Canada refers cases to the Public Prosecution Service of Canada who makes the final decision on whether or not to pursue a prosecution. They make this decision based on specific criteria, including whether they believe:

  • there’s a reasonable prospect of conviction, and
  • pursuing the prosecution is in the public interest

Contraventions (Offences)

On March 27, 2023, Hyundai Auto Canada Corp. pleaded guilty to 6 counts of contravening subsection 10(1) of the Motor Vehicle Safety Act.

This requirement compels Hyundai to advise affected vehicle owners of safety defects no later than 60 days after it notifies Transport Canada and initiates a recall.  

The company notified owners 12 to 43 days longer than the allowable 60 day period.
