Technical arrangement for the Validation of Transport Canada Design Approvals by the Federal Air Transport Agency (Russian Federation)

1.0 Purpose

This Technical Arrangement ( TA ) defines the working procedures between Transport Canada Civil Aviation ( TCCA ) and the Federal Air Transport Agency ( FATA ) of the Russian Federation, herein after referred to jointly as the Authorities, to facilitate the FATA validation of TCCA design approvals, the validation of subsequent design changes, and to address continued airworthiness activities for these design approvals and products for which Canada is the State of Design.

2.0 Objectives

This TA is intended to accomplish the following objectives:

• (a) to define the working procedures under the respective responsibilities of each Authority:
  • (i) in supporting the validation process for TCCA design approvals requiring issuance of equivalent FATA validated design approvals,
  • (ii) the processing of post-validation activities; and
• (b) to minimize redundant inspections, tests, demonstrations, evaluations and approvals.

3.0 Communication

• (1) The Department of Certification of Aeronautical Products of FATA and the Standards Branch ( AART ) of TCCA are responsible for the administration of this TA . The TCCA Standards Branch ( AART ) will work in conjunction with the TCCA National Aircraft Certification Branch ( AARD ) and the various TCCA aircraft certification regional offices who have jurisdiction over the TCCA design approvals and their respective design approval holders in Canada.
• (2) All communications between FATA and TCCA related to the activities of this TA will be made in the English language or Russian language accompanied by an English translation. The contact points for FATA and TCCA are provided in Appendix 1 of this TA . Unless otherwise specified, TCCA shall be copied on all correspondence between the holder of the TCCA design approval and FATA related to the activities of this TA .
• (3) Any disagreement regarding the interpretation or application of this TA will be resolved by consultation between the FATA and TCCA . Every effort should be made to resolve differences at the technical level. Issues that cannot be satisfactorily resolved at the technical level should be expeditiously raised to the attention of the responsible contact points of TCCA and FATA on a progressive level until an agreement or resolution is reached.

4.0 Validation activities

4.1 General

TCCA and FATA recognize that the holder of the TCCA design approval being validated is:

• (a) the primary source for providing technical support to FATA for the purposes of this TA . When requested, TCCA may provide the necessary assistance and support within its regulatory functions and resource capacity; and
• (b) responsible for demonstrating compliance with the FATA certification basis.

4.2 Certification Basis

• (1) The subject of the FATA validation process are those TCCA design approvals that require the issuance of an equivalent FATA validation design approval.
• (2) The TCCA certification basis for each design approval issued under Canadian Aviation Regulations Part V, Subpart 21, ( CAR 521) is defined in the applicable TCCA design approval documents, such as but not limited to, type certificate data sheets, supplemental type certificates, technical standard orders, repair design approvals and parts design approvals.
• (3) The FATA certification basis for purposes of the validation of a TCCA design approval and where required for the issuance of an equivalent FATA validation design approval is the same as that recorded in the applicable TCCA design approval document, plus any Additional Technical Conditions ( ATCs ) notified. FATA will notify in writing to both TCCA and the design approval holder of any ATCs necessary for the FATA validation.

4.3 Findings of Compliance

• (1) FATA will perform its own findings of compliance for the purpose of its validation activity. However, FATA may elect to recognize or accept findings of compliance by TCCA in relation to those requirements for which they have a similar or common interpretation.
• (2) FATA will determine their level of involvement in consultation with TCCA and be guided by one of the primary objectives of this TA , which is to minimize redundant inspections, tests, demonstrations, evaluations and approvals. To the greatest extent practicable, FATA and TCCA may agree on developing a validation work plan that identifies the areas of involvement by FATA as the Validating Authority.
• (3) FATA may request assistance from TCCA in making findings of compliance for those ATCs identified under paragraph 4.2(3), except those requirements or airworthiness standards where TCCA does not have, or has not acquired, sufficient understanding to make a finding of compliance on behalf of FATA .

4.4 Issuance or Acceptance of Design Approval Document

• (1) Where required, FATA will issue its validation design approval document corresponding to the TCCA design approval once it determines the validated type design complies with the FATA certification basis established under section 4.2(3). The FATA approval shall also constitute approval of the applicable aircraft flight manual ( AFM ).
• (2) Where an equivalent FATA design approval document is not required to be issued, FATA will communicate the acceptance of the affected TCCA design approval to TCCA and the design approval holder.

5.0 Post-validation activities

5.1 Design Change Approval

• (1) TCCA shall notify FATA of certain subsequent design changes to type designs validated and issued a validation design approval document by FATA . The following design changes are considered to merit notification to FATA because of its effect on current operating capabilities or build standard of those validated products:
  • (a) Changes to cabin interior configuration classified as a Significant change under CAR 521.158;
  • (b) Changes to the approved Limitations Section of the AFM , either as an amendment or as a supplement;
  • (c) Changes involving new or additional aircraft operating configurations not addressed in FATA ’s accepted AFM , either as an amendment or as a supplement;
  • (d) Changes resulting in revision or amendment to the approved Airworthiness Limitations section of the Instructions For Continued Airworthiness;
  • (e) Changes that affect Additional Technical Condition(s) identified in the FATA validation approval document;
  • (f) Changes involving (or affecting) Exemptions or Findings of Equivalent Safety in the TCCA certification basis; and
  • (g) Changes necessitating the reissuance of FATA ’s validation approval document.
• (2) Following the review by FATA of the design changes notified in paragraph (1) above, FATA shall advise TCCA of either its acceptance of these design changes or its need to conduct validation. Post-validation activities shall continue to be guided by the same objectives of this TA .
• (3) All other design changes approved by TCCA or its appropriately-authorized delegate under section 4.3 of the Aeronautics Act of Canada, and in compliance with the FATA validation basis as determined by TCCA will be considered approved by FATA .

5.2 Service Documents Approval

Subject to paragraph 5.1(1), design changes introduced or contained in Service Bulletins or Technical Instructions, and any subsequent changes or revisions thereto, that are approved by TCCA or its appropriately authorized delegate will be considered approved by FATA .

6.0 Continued airworthiness support activities

• (1) When the service experience within the Russian Federation indicates the existence of a potential unsafe condition associated with the validated design approvals or manufacturing of one of the aeronautical products for which Canada is the State of Design, FATA will promptly notify TCCA of such information. TCCA will promptly analyze this information in coordination with the design approval holder, where appropriate, and will notify FATA of any action it deems necessary.
• (2) In accordance with ICAO Annex 8, Airworthiness of Aircraft, TCCA will promptly notify FATA of any mandatory continuing airworthiness information that TCCA has found necessary for the continuing airworthiness and safe operation of the affected aeronautical products.
• (3) TCCA , upon request, will assist FATA in establishing procedures deemed necessary by FATA for maintaining the continuing airworthiness of those aeronautical products validated or accepted under this TA .
