1.0 Introduction
- (1) This Advisory Circular (AC) is provided for information and guidance purposes. It describes an example of an acceptable means, but not the only means, of demonstrating compliance with regulations and standards. This AC on its own does not change, create, amend or permit deviations from regulatory requirements, nor does it establish minimum standards.
1.1 Purpose
- (1) The purpose of this document is to provide clarification on the use of disposable in-flight service waste bags for the stowage of waste material in aircraft lavatories. It also reminds air operators of the conditions required to ensure a consistent and acceptable level of safety.
1.2 Applicability
- (1) This document applies to commercial air operators conducting operations pursuant to Part VII, Subpart 5 of the Canadian Aviation Regulations (CARs).

- (1) This document, formerly Commercial and Business Aviation Advisory Circular (CBAAC) 0102R, has been reissued as Advisory Circular 705-012. With the exception of minor editorial changes and updated references, the content is unaltered.

3.0 Background
3.1 General
- (1) Commissary and in-flight service items are often boarded in a compact, bulk, and/or stacked fashion (such as rolls of plastic or paper cups, bundles of newspapers, etc.) and, once used, cannot be returned to their boarded fashion to be stowed for landing. This leaves no place other than installed disposal receptacles and when these are full, in-flight service waste bags.
- (2) Air operator inspections have revealed that prior to landing, aircraft lavatories are frequently used as stowage areas for disposable in-flight service waste bags that have accumulated during flight.
- (3) Transport Canada recognizes that even with the implementation of on-board waste management programs, air operators must find stowage areas for used items prior to landing.
- (4) The stowage of disposable waste in aircraft lavatories has been discussed at length between Transport Canada and air operator representatives. These discussions led to a determination that under certain conditions, as described in this AC, an acceptable level of safety could be attained.
4.0 Conditions for the stowage of disposable in-flight service waste in aircraft lavatories
- (1) An air operator may permit the storage of disposable in-flight service waste bags in an aircraft lavatory provided:
- (a) the bags contain only light, low density waste material such as paper or plastic cups and glasses, empty cans, foil meal trays, foil meal coverings, paper napkins, plastic cutlery and cutlery wrappings, food wrappings such as pretzel bags, empty plastic water bottles, used newspapers (not bundled) and other passenger paper waste material generated during the flight;
- (b) the bags are transparent or are fire-containment waste bags;
- (c) the lavatory:
- (i) is located adjacent to a flight attendant station;
- (ii) has a smoke detector system or equivalent specified in paragraph 705.76(a) of the CARs;
- (iii) has a door that has a locking mechanism that can be locked and unlocked externally; and
- (iv) is not used for the storage of any other items;
- (d) despite section 605.09 of the CARs, the smoke detector system or equivalent specified in paragraph 705.76(a) and the locking mechanism is operative;
- (e) prior to its placement in the lavatory, a flight attendant ensures that the content of each bag is restricted to the material set out in paragraph (a) above;
- (f) the bags are stowed in accordance with the following procedures;
- (i) all installed disposal receptacles located in the galley area shall be used first;
- (ii) each bag is placed in a lavatory so that the bag, or combination of bags, does not surpass the height of the lavatory sink;
- (iii) each bag is stowed in the lavatory only during the final phase of flight after the fasten safety belt sign has been illuminated to indicate descent in preparation for landing;
- (iv) the lavatory door shall be closed and locked to preclude passenger access when it is used for the stowage of bags of waste;
- (v) a bag of waste that was stowed in a lavatory prior to landing shall be removed and off loaded after each landing; and
- (g) the air operator has established the procedures set out in paragraphs (a) to (f) above in its flight attendant manual, company operations manual, and flight attendant training program.
