1.0 Introduction

(1) This Advisory Circular (AC) is provided for information and guidance purposes. It describes an example of an acceptable means, but not the only means, of demonstrating compliance with regulations and standards. This AC on its own does not change, create, amend or permit deviations from regulatory requirements, nor does it establish minimum standards.

1.1 Purpose

(1) The purpose of this AC is to announce the implementation of a change to the Criteria for the Development of Instrument Procedures (TP308/GPH209).

1.2 Applicability

(1) This document is applicable to all Transport Canada Civil Aviation (TCCA) employees and to individuals or organizations when they are exercising privileges granted to them under an External Ministerial Delegation of Authority. This information is also available to the aviation industry for information purposes.

1.3 Description of Changes

(1) Issue 15 of this AC introduces TP308/GPH209 Change 9.1.

(2) The Criteria for the Development of Instrument Procedures (TP308/GPH209) Change 9.1 focuses on updating Volume 1, Chapter 11 “Helicopter Procedures’’ and Chapter 12 “DP Construction’’. In addition, Change 9.1 provides clarification on Instrument Flight Procedure aerodrome requirements in Volume 1 paragraph 120, adds helicopter criteria in the general criteria, changes shall to must where appropriate, updates paragraph references due to reformatting of Volume 1 Chapter 2 and harmonizes the adjustment requirement with that of the Federal Aviation Administration’s (FAA) Terminal Instrument Procedures (TERPS).

2.0 References and requirements

2.1 Reference documents

(1) It is intended that the following reference materials be used in conjunction with this document:

• (a) Aeronautics Act (R.S.C., 1985, c. A-2);
• (b) Part VIII Subpart 03 of the Canadian Aviation Regulations (CARs) — Aeronautical Information Services; and
• (c) Transport Canada Publication (TP) 308/GPH 209 — Criteria for the Development of Instrument Procedures, Change 9.1, 2025-01-01.

2.2 Cancelled Documents

(1) By default, it is understood that the publication of a new issue of a document automatically renders any earlier issues of the same document null and void.

2.3 Definitions and Abbreviations

(1) The following abbreviations are used in this document:

• (a) AC: Advisory circular;
• (b) CAR: Canadian Aviation Regulations;
• (c) CARAC: Canadian Aviation Regulation Advisory Council;
• (d) CAT: Category;
• (e) FAA: Federal Aviation Administration;
• (f) IAP: Instrument Approach Procedure;
• (g) ICAO: International Civil Aviation Organization;
• (h) NPA: Notice of Proposed Amendment;
• (i) SA: Special Authorization;
• (j) TCCA: Transport Canada Civil Aviation;
• (k) TP: Transport Canada Publication; and
• (l) TSB: Transportation Safety Board

3.0 Background

(1) Subsection 803.02(a) of the Canadian Aviation Regulations (CARs) states that no person shall publish or submit for publishing in the Canada Air Pilot an instrument procedure unless the procedure has been developed in accordance with the standards and criteria specified in the manual entitled Criteria for the Development of Instrument Procedures (TP308/GPH209).

(2) Instrument Procedure Design Criteria contained in TP308/GPH209 are based on the United States FAA Orders pertaining to the development of Instrument Procedures.

(3) The criteria contained in TP308/GPH209 is amended from time to time, in response to: changes introduced by the FAA to their Orders, changes to technology, and recommendations received from stakeholders.

4.0 Information changes in TP308/GPH209 Change 9.1

(1) The significant areas of new direction, guidance, and policy included in this change are detailed in the “Revision - Change Page” section of TP308/GPH209 Change 9.1.

(2) The standards and criteria found in TP308/GPH209 is periodically amended to harmonize with the FAA’s TERPS criteria to the extent possible.

(3) In this change, Volume 1, Chapter 11 “Helicopter Procedures” and Chapter 12 “DP Construction” criteria has been updated to harmonize with the FAA TERPS

(4) Instrument approach procedure designs are based on the aerodrome requirements stated in TP308/GPH209 Volume 1, Chapter 1, paragraph 120. This paragraph has been amended to clearly state the requirement for:

• (a) TP312 standards for certified aerodromes,
• (b) An aerodrome attestation based on the standards of TP312 5^th Edition and the guidance found in AC 301-001 for non-certified aerodromes,
• (c) A take-off surface per TP312 5th Edition under certain circumstances, and
• (d) Publication as a restricted procedure with a minima of 500 feet HAA/HAT or greater when the aerodrome has no status.

5.0 Requirements

5.1 Implementation

(1) Effective April 1, 2025:

• (a) TP308/GPH209 Change 9.1 Volume 1, Chapter 1.

(2) Effective April 1, 2027:

• (a) TP308/GPH209 Change 9.0 is superseded.
• (b) Except for the items listed below, TP308/GPH209 Change 9.1 is effective and TP308/GPH209 Change 8.1 is revoked. For the following items, TP308/GPH209 Change 8.1 remains effective and must continue to be used until revoked:
  • (i) TP308/GPH209 Change 9.1 Volume 1, Paragraph 2.7.3 – Continue using TP308/GPH209 Change 8.1 Volume 1, Paragraph 2.6.3 including figures 2-6-11 and 2-6-12 and table 2-6-3;
  • (ii) TP308/GPH209 Volume 1, Chapter 3; and
  • (iii) TP308/GPH209 Change 9.1 Volume 1, Paragraphs 11.3.2 and 11.3.3 – Continue using TP308/GPH209 Change 8.1 Volume 1, Paragraphs 1126 and 1127.
• (c) Where TP308/GPH209 Change 9.1 references Volume 1, Chapter 3, the applicable reference provided in TP308/GPH209 Change 8.1 must be applied.

(3) Upon coming into force of the new approach ban regulation in CAR 602.129:

• (a) TP308/GPH209 Change 9.1 becomes effective in its entirety and all TP308/GPH209 Change 8.1 is revoked.

5.2 Training

(1) In adherence to Subsection 803.02(b) of the CARs, no person shall publish or submit for publishing an instrument procedure unless the procedure has been developed by a person who has successfully completed training which has been accepted by the Minister.

(2) No additional training is required for use of TP308/GPH209 Change 9.1. Previous training requirements apply and previously accepted training is valid.
