1.0 Introduction

(1) This Advisory Circular (AC) is provided for information and guidance purposes. It describes an example of an acceptable means, but not the only means, of demonstrating compliance with regulations and standards. This AC on its own does not change, create, amend or permit deviations from regulatory requirements, nor does it establish minimum standards.

1.1 Purpose

(1) The purpose of this AC is to announce the implementation of a change to the Criteria for the Development of Instrument Procedures (TP308/GPH209).

1.2 Applicability

(1) This document is applicable to all Transport Canada Civil Aviation (TCCA) employees and to individuals or organizations when they are exercising privileges granted to them under an External Ministerial Delegation of Authority. This information is also available to the aviation industry for information purposes.

1.3 Description of Changes

  • (1) Issue 14 of this AC introduces TP308/GPH209 Change 9.0.
  • (2) The Criteria for the Development of Instrument Procedures (TP308/GPH209) Change 9.0 focuses on Chapter 3, Take-off and Landing Minima, and the determination of prescribed visibility minima to support the approach ban regulatory initiative.

2.1 Reference documents

2.2 Cancelled Documents

(1) By default, it is understood that the publication of a new issue of a document automatically renders any earlier issues of the same document null and void.

2.3 Definitions and Abbreviations

(1) The following abbreviations are used in this document:

  • (a) AC: Advisory circular;
  • (b) CAR: Canadian Aviation Regulations;
  • (c) CARAC: Canadian Aviation Regulation Advisory Council;
  • (d) CAT: Category;
  • (e) FAA: Federal Aviation Administration;
  • (f) IAP: Instrument Approach Procedure;

  • (h) NPA: Notice of Proposed Amendment;
  • (i) SA: Special Authorization;

3.0 Background

  • (1) Subsection 803.02(a) of the Canadian Aviation Regulations (CARs) states that no person shall publish or submit for publishing in the Canada Air Pilot an instrument procedure unless the procedure has been developed in accordance with the standards and criteria specified in the manual entitled Criteria for the Development of Instrument Procedures (TP308/GPH209).
  • (2) Instrument Procedure Design Criteria contained in TP308/GPH209 are based on the United States Federal Aviation Administration (FAA) Orders for the development of Instrument Procedures.
  • (3) The Canadian Aviation Regulation Advisory Council (CARAC) issued Notice of Proposed Amendment (NPA) 2021-011 on July 6, 2021 which gave notice of a proposal to amend CARs pertaining to approach ban. The purpose of this initiative is to address the Transportation Safety Board’s (TSB) recommendations to simplify operating minima for approaches and landing and to implement a mechanism to stop approaches and landings that are actually banned.
  • (4) To support the approach ban initiative, Volume 1, Chapter 3 of TP308/GPH209 is updated to support the use of the charted visibility as a prescribed visibility instead of as an advisory visibility. The amended Chapter 3 also brings its content into alignment with that of the FAA’s TERPS criteria. Editorial changes throughout the document are also made to ensure references to Volume 1, Chapter 3 content are correct. Amendments in chapters 11 and 13 ensure proper determination of visibilities for applications in helicopter, Special Authorization (SA) CAT I, CAT II, and CAT III operations.
  • (5) The criteria contained in TP308/GPH209 is amended from time to time, in response to: changes introduced by FAA to their Orders, changes to technology, and recommendations received from stakeholders.

4.0 Information changes in TP308/GPH209 Change 9.0

  • (1) The significant areas of new direction, guidance, and policy included in this change are detailed in the “Revision - Change Page” section of TP 308/GPH209 Change 9.0.

5.0 Requirements

5.1 Implementation

  • (1) 01 January 2024 – The final, signed version of TP308/GPH209 Change 9.0 is available for use. However, instrument procedures developed using the new Chapter 3 criteria may not be made effective until the new approach ban regulation of CAR 602.129 come into force.
  • (2) Upon coming into force of the new approach ban regulation in CAR 602.129 – TP308/GPH209 Change 9.0 is effective and instrument procedures based on the new Chapter 3 criteria may be published. Change 8.1 and 8.0 are no longer authorized for the development of new instrument procedures.
  • (3) TP308/GPH209 Change 9,0 Volume 1, Chapter 13, Section 13-4 Special Authorization (SA) CAT I will be available for use when the supporting SA CAT I AC becomes available.

5.2 Training

  • (1) In adherence to Subsection 803.02(b) of the CARs, no person shall publish or submit for publishing an instrument procedure unless the procedure has been developed by a person who has successfully completed training which has been accepted by the Minister.
  • (2) Training is required for use of TP 308/GPH209 Change 9.0, Volume 1, Chapter 3. Previous training requirements apply and previously accepted training is valid.
