 Type Certification of Aircraft Certificated to SFAR 41C or FAR Part 23 Commuter Category

Applicability

This notice applies to propeller-driven multi-engine aeroplanes having:

  • a maximum certificated take-off weight of 5670 kg (12,500 lb) or less and a passenger seating configuration, excluding pilot seats, of 10 seats or more (but not more than 19 seats), and a type certification by the airworthiness authority of the country of manufacture to Special Federal Aviation Regulation (SFAR) 41C;
  • a maximum certificated take-off weight in excess of 5670 kg (12,500 lb) and a seating configuration of 19 or less, excluding pilot seats, and a type certification by the airworthiness authority of the country of manufacture to SFAR 41C, together with the provisions of ICAO Annex 8 in accordance with paragraph 4(c) of SFAR 41C; or
  • a maximum certificated take-off weight of 8618 kg (19,000 lb) or less and a seating configuration of 19 or less, excluding pilot seats, and a type certification by the airworthiness authority of the country of manufacture to FAR Part 23 as amended to include Amendment 23-34 (Commuter Category Aeroplanes).

Aircraft Type Certificate

Imported aeroplanes certificated by the airworthiness authority of the country of manufacture to SFAR 41C or FAR Part 23 Commuter Category standards will be eligible for a Canadian Aircraft Type Certificate, subject to a type design examination of the aircraft by Transport Canada.

Note: Aircraft type certificated to SFAR 41C are eligible for a Canadian Type Certificate at maximum certificated take-off weights in excess of 5670 kg (12,500 lb) only if they are also in compliance with the provisions of ICAO Annex 8.

The issue of an Aircraft Type Certificate for this category of aircraft is a prerequisite for obtaining a Certificate of Airworthiness for Canadian registered aircraft.

Basis of Certification

The basis for the Canadian Aircraft Type Certificate will consist of:

  •  the basis of certification in the country of origin (SFAR 41C together with the performance requirements of ICAO Annex 8, or FAR Part 23 at Amendment 23-34) with appropriate Additional Technical Conditions, including Special Conditions to address novel or unusual design features; or
  • the airworthiness standards of Chapter 523 of the Airworthiness Manual as amended by Change 523-1 dated 1 January 1988,  and subsequent amendments, and Special Conditions, as applicable.

In addition, aeroplanes shall comply with the applicable environmental protection (aircraft noise, fuel venting and engine emission) requirements ofCanadian Aviation Regulations (CAR) Part V, Subpart 16.

Aircraft Operation

Aeroplanes in these categories that have received a Canadian Aircraft Type Certificate, and that are to be used in commercial operations, will be operated in accordance with the applicable requirements of CARs Part VI and Part VII.
