AUTHORIZATION PURSUANT TO PARAGRAPH 702.22(2)(a) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to paragraph 702.22(2)(a) of the Canadian Aviation Regulations and after taking into account that the authorization is in the public interest and is not likely to affect aviation safety, I hereby authorize Talon Helicopters Ltd., Executive Aircraft, 4380 Agar Drive, Richmond, B.C., and their flight crew member to operate a helicopter over a built-up area at altitudes and distances less than those specified in paragraph 602.14(2)(a).

Paragraph 702.22(2)(a) states that for the purpose of paragraph 602.15(2)(a) a person may operate an aircraft over a built-up area at altitudes and distances less than those specified in paragraph 602.14(2)(a), if the person has an authorization from the Minister or is authorized to do so in an air operator certificate.

PURPOSE

The purpose of this authorization is to permit Talon Helicopters Ltd., Executive Aircraft, 4380 Agar Drive, Richmond, B.C, to operate a helicopter at altitudes and distances less than those specified in paragraph 602.14(2)(a).

APPLICATION

This authorization applies only to Talon Helicopters Ltd., Executive Aircraft, 4380 Agar Drive, Richmond, B.C., when operating for the purpose of aerial photography for the commercial “Skipper”, Municipality of Delta, B.C.

CONDITIONS

This authorization is subject to the following conditions:

  1. The operation shall take place between Wednesday, July 5, 2006, between the hours of 07:00 and 21:20 Pacific Daylight Savings Time, depending on suitable weather conditions.
  2. Operations shall be conducted within the specified hours, under Day VFR conditions, using an AS350 type helicopter.
  3. The site of the operation shall be as depicted on the map submitted and held on file with Commercial and Business Aviation, Pacific Region; being the Westham Island bridge, Municipality of Delta, B.C.
  4. The aircraft shall at all times be flown along a flight path which, in case of an engine failure or other in-flight emergency necessitating an immediate landing, shall ensure a suitable (autorotational) landing site without endangering persons or property on the ground, or on the water.
  5. The aircraft shall be flown in compliance within the “Height-Velocity” Diagram contained with the approved Aircraft Flight Manual.
  6. The aircraft shall conduct a power check immediately before commencing the operations, and the engine shall be at, or above, the manufacturers specifications.
  7. When over water beyond gliding distance from shore, all provisions of Operations Specification #45 shall be complied with.
  8. When exercising the privileges of this Authorization, and flying to the north side of the Westham Island bridge, Municipality of Delta, B.C., the minimum height of the aircraft shall not be below the bridge deck height.
  9. When exercising the privileges of this Authorization, and flying to the south side of the Westham Island bridge, Municipality of Delta, B.C., the minimum height of the aircraft shall never be less than 300 feet above sea level.
  10. When exercising the privileges of this Authorization, the aircraft shall remain clear of the Marina located immediately South East of the Westham Island bridge, Municipality of Delta, B.C.
  11. When exercising the privileges of the Authorization, the aircraft shall remain clear of any building, residential area or open-air assembly of persons by not less than 300 feet.
  12. When exercising the privileges of this Authorization, the aircraft shall not over fly any building.
  13. When exercising the privileges of this Authorization, the Westham Island bridge, Municipality of Delta, B.C., shall be closed, clear of, and access denied to all vehicular and pedestrian traffic not directly involved with the aerial photography operation.
  14. When exercising the privileges of this authorization, the Westham Island rifle range immediately to the west of the Westham bridge shall not be active.
  15. The transit route to and from the site as under (c) above shall be flown in accordance with Canadian Aviation Regulation 602.14, Minimum Altitude and Distances.
  16. All personnel involved shall be briefed on the operation, safety precautions and emergency procedures before flight operations commence.
  17. Persons carried on board the helicopter shall be limited to essential crew only.
  18. A copy of this authority shall be carried on board the aircraft while operating in Canada.
  19. Where required, the operation shall be coordinated with the appropriate Air Traffic Control authority.
  20. The company shall comply with the Commercial Air Service Standards as required under CAR 702.22(2)(b).

VALIDITY

The authorization is in effect until the earliest of the following:

  1. 21:20 hours Pacific Daylight Savings Time on Wednesday, July 5, 2006;
  2. the date on which any of the conditions set out in this authorization is breached; or 
  3. the date on which this authorization is cancelled, in writing, by the Minister, where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.
