AUTHORIZATION PURSUANT TO PARAGRAPHS 702.22(1)(a) AND 702.22(2)(a) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to paragraphs 702.22(1)(a) and 702.22(2)(a) of the Canadian Aviation Regulations and after taking into account that the authorization is in the public interest and is not likely to affect aviation safety, I hereby authorize Blackcomb Helicopters Ltd., Box 1241, Whistler, B.C., and their flight crew member to conduct a take-off, approach or landing in an aircraft within a built-up area of a city or town at a place other than an airport or a military aerodrome and to operate a helicopter over a built-up area at altitudes and distances less than those specified in paragraph 602.14(2)(a).

Paragraph 702.22(1)(a) states that for the purposes of subsection 602.13(1) a person may conduct a take-off, approach or landing in an aircraft within a built-up area of a city or town at a place other than an airport or a military aerodrome, if the person has an authorization from the Minister or is authorized to do so in an air operator certificate.

Paragraph 702.22(2)(a) states that for the purpose of paragraph 602.15(2)(a) a person may operate an aircraft over a built-up area at altitudes and distances less than those specified in paragraph 602.14(2)(a), if the person has an authorization from the Minister or is authorized to do so in an air operator certificate.

PURPOSE

The purpose of this authorization is to permit Blackcomb Helicopters Ltd., Box 1241, Whistler, B.C., to conduct take-offs and landings in an aircraft within a built-up area of a city or town and to operate a helicopter over a built-up area at altitudes and distances less than those specified in paragraph 602.14(2)(a).

APPLICATION

This authorization applies only to Blackcomb Helicopters Ltd., Box 1241, Whistler, B.C., when operating for the purpose of aerial photography for the motion picture production “Mimzy” within the City of Coquitlam, B.C.

CONDITIONS

This authorization is subject to the following conditions:

  1. The operation shall take place on Saturday, May 27, 2006, alternatively on Sunday, May 28, 2006, between the hours of 05:30 and 21:00 Pacific Daylight Savings Time (PDST), depending on suitable weather conditions.
  2. Operations shall be conducted within the specified hours, under VFR conditions, using an AS355 type helicopter.
  3. The site of the operation shall be the aerial work zone outlined in white, as follows:

  1. The pilot shall be Mr. Jim Filippone, License No. CH259531.
  2. The aircraft shall at all times be flown along a flight path which, in case of an engine failure or other in-flight emergency necessitating an immediate landing, shall ensure a suitable (autorotational) landing site without endangering persons or property on the ground.
  3. The aircraft shall be flown in compliance within the “Height-Velocity” Diagram contained with the approved Aircraft Flight Manual.
  4. The aircraft shall conduct a power check immediately before commencing the operations, and the engines shall be at, or above, the manufacturers specifications.
  5. The aircraft indicated airspeed (IAS) shall be more than the safe single-engine speed (Vsse) when no suitable landing area is available.
  6. The aircraft shall be configured such that safe single engine fly away is assured at all times.
  7. The landing zone within the aerial work zone as under (c) above, shall be clearly marked, secured, free of, and access denied to all vehicular and pedestrian traffic.
  8. When exercising the privileges of this Authorization, the minimum height of the aircraft shall never be less than 100 feet above ground level (AGL).
  9. When exercising the privileges of this Authorization, the aircraft shall remain clear of Lougheed Highway at all times.
  10. When exercising the privileges of this Authorization, the aerial work zone as under (c) above, shall be secured, free of, and access denied to all vehicular and pedestrian traffic not directly involved with the motion picture production.
  11. Prior to exercising the privileges of this Authorization, traffic advisory signs advising traffic of “Low Flying Helicopter Operations in Progress” shall be posted along the Lougheed Highway at the North and South end of the aerial work zone.
  12. The transit route to and from the zone as under (c) above shall be flown in accordance with Canadian Aviation Regulation 602.14, Minimum Altitude and Distances.
  13. All personnel involved shall be briefed on the operation, safety precautions and emergency procedures before flight operations commence.
  14. Persons carried on board the helicopter shall be limited to essential crew only.
  15. The local police authorities and municipalities concerned shall be informed of and acknowledge the operation.
  16. A copy of this authority shall be carried on board the aircraft while operating in Canada.
  17. The Company shall comply with the Commercial Air Service Standards as required under CAR 702.22(1)(b) and 702.22(2)(b).

VALIDITY

The authorization is in effect until the earliest of the following:

  1. 21:00 hours PDST, British Columbia, on Sunday, May 28, 2006
  2. the date on which any of the conditions set out in this authorization is breached; or
  3. the date on which this authorization is cancelled, in writing, by the Minister, where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.
