EXEMPTION FROM CLAUSE 705.124(2)(b)(iv)(B) OF THE CANADIAN AVIATION REGULATIONS, AND PARAGRAPHS 7.3.1(a) OF THE INITIAL AND 7.1.1(a) OF THE ANNUAL PART SEVEN OF THE FLIGHT ATTENDANT TRAINING STANDARD (TP12296) MADE PURSUANT TO PARAGRAPH 705.124(1)(b)...

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to adversely affect aviation safety, I hereby exempt Jazz Aviation LP, Airway Centre, Suite 318, 5955 Airport Road Mississauga, Ontario  L4V 1R9, from the requirements of clause 705.124(2)(b)(iv)(B) of the Canadian Aviation Regulations (CARs) and from the requirements of paragraph 7.3.1(a) (Initial) and 7.1.1(a) (Annual) of the Flight Attendant Training Standard (TP12296) made pursuant to paragraph 705.124(1)(b) of the CARs, subject to the conditions set out below.

Paragraph 705.124(1)(b) of the CARs stipulates that every air operator shall establish and maintain a training program that is approved by the Minister in accordance with the Commercial Air Service Standard (CASS) and the Flight Attendant Training Standard.

Clause 705.124(2)(b)(iv)(B) of the CARs stipulates that an air operator’s training program shall include, for flight attendants: initial and annual training, including aircraft type training.
Paragraph 7.3.1(a) of the Flight Attendant Training Standard (Initial) states: Each drill shall be performed using the appropriate aircraft or approved training device”.

Paragraph 7.1.1(a) of the Flight Attendant Training Standard (Annual) states: Each drill shall be performed using the appropriate aircraft or a training device approved in accordance with Section 705.126 of the Canadian Aviation Regulations”.

PURPOSE

The purpose of this exemption is to allow Jazz Aviation LP to conduct one window exit operation drill, by utilizing either a DHC-8 100/300 window exit or a CRJ 100/200/705 overwing exit (OWE) to qualify trainees on both aircraft types and meet the requirements of operating each window exit during Initial and Annual Flight Attendant Training as required by section 7.3.1(a) Initial Part Seven and section 7.1.1(a) Annual Part Seven of the Flight Attendant Training Standard.

APPLICATION

This exemption is applicable only to Jazz Aviation LP’s flight attendant training programs, pertaining to the aircraft window exit operation drill.

CONDITIONS

This exemption is subject to the following conditions:

  1. Jazz Aviation LP shall amend its Initial and Annual Flight Attendant Training Programs to  include and emphasize the differences between the DHC-8 100/300 window exit and the CRJ 100/200/705 OWE;
  2. Jazz Aviation LP shall use this exemption only and for the sole purpose of conducting Jazz Aviation LP’s flight attendant initial training and annual programs pertaining to the over wing exit operation drills;
  3. Jazz Aviation LP shall clearly identity in each flight attendant’s training record which window exit was used as an equivalent means to operating the other type of over wing exit for aircraft operation drills;
  4. Jazz Aviation LP shall ensure that each flight attendant attending initial and annual training meets all of the other applicable requirements as set in the CARs, the CASS and the Flight Attendant Training Standard.

VALIDITY

This exemption is in effect until the earliest of the following:

  1. December 1, 2013 at 23:59 EST;

  2. the date on which any of the conditions set out in this exemption is breached; or

  3. the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it no longer in the public interest, or that it is likely to adversely affect aviation safety.
