EXEMPTION FROM PARAGRAPH 401.06(1)(b) OF THE CANADIAN AVIATION REGULATIONS (CARs) AND SUBPARAGRAPHS 421.40(3)(a)(ii) AND 421.40(3)(b)(iii) OF THE PERSONNEL LICENSING AND TRAINING STANDARDS RESPECTING FLIGHT CREW PERMITS, LICENCES AND RATINGS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that this exemption is in the public interest and is not likely to adversely affect aviation safety, I hereby exempt all applicants who have successfully completed a Transport Canada (TC)-approved Integrated Airline Transport Pilot (ATP) Course from the requirement to have accumulated at least 250 hours of aeroplane flight time prior to holding an individual aircraft type rating for aeroplanes with a minimum flight crew requirement of at least two pilots as set out in subparagraphs 421.40(3)(a)(ii) and 421.40(3)(b)(iii) of the Personnel Licensing and Training Standards Respecting Flight Crew Permits, Licences and Ratings, made pursuant to paragraph 401.06(1)(b) of the CARs. This exemption is subject to the conditions set out below.

The details of the above provisions are attached at Appendix A.

Purpose

The purpose of this exemption is to permit applicants who have successfully completed a TC approved integrated ATP course to hold an individual aircraft type rating for aeroplanes with a minimum flight crew requirement of at least two pilots without having to acquire 250 hours of aeroplane flight time as stated in Subparagraphs 421.40(3)(a)(ii) and 421.40(3)(b)(iii) of the CARs. .

Application

This exemption applies to all applicants who have successfully completed a Transport Canada (TC)-approved Integrated Airline Transport Pilot (ATP) Course

Conditions

This exemption is subject to the following conditions:

  1. Applicants shall have successfully completed a TC-approved Integrated Airline Transport Pilot Course;
  2. Applicants shall have completed flight training on the aeroplane type; and
  3. Applicants shall meet the knowledge and skill requirements as detailed in Paragraphs 421.40(3)(a) or 421.40(3)(b) of the CAR, as applicable that deal with aeroplanes requiring a minimum crew of two pilots.

Validity

This exemption is in effect until the earliest of the following:

  1. September 30, 2008, at 23:59 EDT;
  2.  The date on which an amendment to the appropriate provisions of the Canadian Aviation Regulations comes into effect;
  3.  The date on which the condition set out in this exemption is breached; or
  4.  The date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest or that it is likely to affect aviation safety.
