EXEMPTION FROM PARAGRAPH 401.06(b) OF THE CANADIAN AVIATION REGULATIONS AND PARAGRAPH 421.30(4)(a) OF THE FLIGHT CREW PERMITS, LICENCES AND RATINGS STANDARD

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety,

I hereby exempt applicants for a commercial pilot licence who have successfully completed an approved integrated CPL(A) or CPL(A)/IR course from the requirements set out in paragraph 421.30(4)(a) of Standard 421 – Flight Crew Permits, Licences and Ratings made pursuant to paragraph 401.06(b) of the Canadian Aviation Regulations, subject to the following conditions.

Paragraph 421.30(4)(a) of Standard 421 – Flight Crew Permits, Licences and Ratings sets out the requirements to be met by an applicant for a Commercial Pilot Licence-Aeroplane and stipulates an experience requirement of a minimum of 200 hours flight time in aeroplanes of which a minimum of 100 hours is pilot-in-command time, including 20 hours cross-country pilot-in-in command flight time;

Paragraph 401.06(b) of the CARs states that the Minister shall, on receipt of an application submitted in the form and manner specified in the personnel licensing standards, issue a flight crew permit or licence to the applicant or endorse the applicant's flight crew permit or licence with a rating if the applicant provides documentation to the Minister that establishes that the applicant meets the applicable requirements set out in the personnel licensing standards in respect of minimum age, medical fitness, knowledge, experience, and skill.

Purpose

The purpose of this exemption is to allow:

Applicants for a commercial pilot licence who have successfully completed an approved integrated CPL(A) course to obtain a Commercial Pilot Licence-Aeroplane with an experience requirement of 150 hours total flight time, 70 hours of which is pilot-in-command time; including 30 hours of cross-country pilot-in-command flight time;

Applicants for a commercial pilot licence who have successfully completed an approved integrated CPL(A)/IR course to obtain a Commercial Pilot Licence-Aeroplane with an experience requirement of 190 hours total flight time, 90 hours of which is pilot-in-command time, including 50 hours of cross-country pilot-in-command flight time.

Application

This exemption applies to all applicants for a commercial pilot licence who have successfully completed an approved integrated CPL(A) or CPL(A)/IR course.

Conditions

This exemption is subject to the following conditions:

  1. Applicants for a commercial pilot licence who have successfully completed an approved integrated CPL(A) or CPA(A)/IR course shall have completed all required flight time and ground time;
     
  2. Applicants for a commercial pilot licence who have successfully completed an approved integrated CPL(A) or CPA(A)/IR course shall have passed all required practical tests and knowledge tests; and
     
  3. Applicants for a commercial pilot license who have successfully completed an approved integrated CPL(A) or CPA(A)/IR course shall provide to Transport Canada or an authorized person acceptable proof, from the Flight Training Unit, of graduation from the approved course.

Validity

This exemption is in effect until the earliest of the following:

  1. EST at midnight on November 30, 2003;
     
  2. the date on which any condition set out in this exemption is breached;
     
  3. the date on which an amendment to the appropriate provisions of the CARs comes into effect; or
     
  4. the date on which this exemption is canceled in writing by the Minister where he is of the opinion that it is no longer in the public interest or is likely to affect aviation safety.
